Most .js projects use the Expat/MIT license, so I assumed that for this project, as well. However, your are right, upstream is unclear about the MIT nuance that is actually meant in that quoted above passage.

Also, the tarball appears to have an unreadable file:
   require-kernel-1.0.6\test\modules\root\spa

Nonono... the path is incomplete...
