I don't see any > code in initscripts that would create /lib/init/rw. I just double-checked, including rebooting a current sid system in a VM, and it's not created at boot there. I did have an empty /lib/init/rw[/sendsigs.omit.d] on my main system, but removing it and rebooting did not result in it being recreated. Do you have another package with an init script which recreates it? The only recent change relating to /lib/init/rw is relating to bootclean, where we clean it before mountall so that if there was any residual data in the directory from upgrade, we clean it out to save space.
