Why put malicious code in the first place? The other contributors will
notice that anyway via version control (git, svn, mercurial, etc..) .

Opensource is a meritocracy. Putting a malicious component, or function
without the knowledge of other parties is damaging to your community merits
and it will spread like wildfire to other communities that you will most
likely participate in in the future.

Suing the programmer is the prerogative of the party who bought the code .
