I think there's a mistake in that 2 lines:
/** Tabs */
$('#uiLayoutEast').pmTabs(PM.tocTabs); // Tabs for TOC/legend swap
$('#toc, #toclegend').top(30); // make some space for tabs
so instead of that #uiLayoutEast replace with #tocContainer.
i think this will solve the problem..
