I was involved in a medical malpractice suit once. My lawyers walked in and the initial proposal was "$2 million or you can go fuck yourselves and we'll see you in court". The other side countered "$1 million or you can go fuck yourselves and we'll see you in court". Then both sides stormed out of the room in a huff and went and drank coffee and ate Danish's for awhile. By close of the day we settled somewhere near the middle. That's how it's done.
