I just pulled up the docket on this case on PACER, and nothing has changed....This judge could sit on the pending Motions until after the election. My initial reaction to this matter was that Berg didn't have much of a chance, and that the complaint had some serious flaws in it. Attorney Berg corrected a number of those complaints in his September 29, 2008 Response In Opposition To Dismiss (The Complaint) filed by Senator Obama and the Democratic National Convention. Having said that, on October 6, 2008, Senator Obama filed a Motion for A Protective Order to Stay the Discovery Process, of which the Court has not ruled upon. I have seen this on numerous occasions, where the Court will grant such a Motion, and not hold the plaintiff in default. In other words, I don't put a lot of credence in Berg's Request For Admissions, and the fact that Senator Obama and his attorneys have not to date answered them.
