This is an alleged sexual harrasment and unlawful termination case.

Plaintiff's position:

Plaintiff is 50 year old female former veteran navy recruiter (single mom).
National company is a university that teaches “male traits” (according to
company supervisor).  Company hired Plaintiff to fill a recruiter position
on military team consisting of 30 individuals and (two females, including
Plaintiff). After hire,the company puts Plaintiff in training.




Male co-workers and male supervisors refer to her a “cougar,” “grandma,”
make fun of her handshake, belittle her, take bets on how long she will
last, make sexual comments to her, and make statements like, “since you are
a woman, you will be singled out, “ and “we don’t want a woman touching our
computer.”


Plaintiff objects to the treatment to her sexist supervisor only. After
training, and four months after her hire, company fires Plaintiff and the
other female on the team who had been there since 2007, stating that they
were doing a “reduction in force.”  The men involved in the decision to
fire her and the other woman (wiping out all female reps), made the sexist
statements to her during her training. Two days later, company hires two
men into positions in other regions and continues to hire men to fill
positions Plaintiff was in (with less tenure) including the region she
worked (in about 8 months later).  Although Plaintiff was more qualified
than other men, more experienced and had more licenses, company says they
fired her because she “could not fill requirements of position” – .

Company's position




Company takes the position that Plaintiff was fired due to economic reasons
along with other representatives (men and women) and that she lied during
interview that she could get on a navy base in Jacksonville (which she
wasn’t able to do because of Admiral who did not allow anyone on the base
from the company). Company also states she was not good on computers which
was a requirement of the job. Company also states that Plaintiff failed to
ever complain of sexual harassment or gender discrimination during her
employment to Human Resources and the first time they heard about
discrimination was after her termination.  Company states she was not
transferred to another region in lieu of firing because she did not ask for
it and could not travel because she is a single mom and sent an email after
her firing thanking the company for the opportunity. Further, harassment
she endured was not sexual harassment and is tenuous. Company says they
fired her because she “could not fill requirements of position” – based
upon an inability to create a signature line on an email, for example.

What is that company is and what does it do. The company is a university ?
It teaches male traits ?


Plaintiff  has sued Corin Colleges and Ytech. Corin is a private college
that owns Yotech. The plaintiff worked for both but more specifically for
Yotech. The Yotech campus focuses on teaching automotive technology,
motorcycle mechanics, auto refinishing, plumbing and electrical. In a
deposition, the supervisor was asked why there were not more women students
and the supervisor said because the school teaches “male traits.”There are
female students there and female mechanics.


If this is true then why would they hire a woman in the first place?
Plaintiff was hired to work on the Military Admissions Team. This was a
team that had 3 0individuals who all are former military. The team focused
on recruiting individuals who are retiring from the military. When
Plaintiff was hired, there was only one other female on the team. She was
hired as the second female. Kelly (the other female) had been there since
2007 and was also fired at the same time as the Plaintiff. She is also
suing the company for gender discrimination and her trial is scheduled for
June of 2014 in Los Angelas.


How long was she working for that company and what job did she have before
getting hired? (as a navy recruiter)? Are there any females working there?
 The Plaintiff worked for the company for a little less than 5 months.
Prior to getting hired by the company she worked in a clothing boutique for
several years.


Did Plaintiff take eligibility tests prior to being employed?
 No eligibility tests prior to being hired but knowledge of mechanics is
not a pre-req and all supervisors admit that she had the ability to do the
job.


Did Plaintiff take and complete any computer classes and receive
certification for same?
No,  however, she does know how to work a computer and currently teaches
computer training at her new job.


Was the Plaintiff the first female this;companyever hired?
No she was the second female on the Military Team. There are other females
that work for the company but not on the team. The Military team has not
hired any women since her firing (and the other female’s firing). There was
another female on the team at one point but she quit.





Has there ever been documented suspicion or proof of sexual harassment in
this company prior to this incident?
The company has had other claims of sexual harassment but none in
litigation.






Did anyone subpoena company payroll records and see P ; L statements for
the company the year before and the year after Plaintiff was hired and
fired?
In the year prior to her hire and the year of her hire, the company was
doing extremely well or making revenue. Since that time, the company has
had several RIFs (which is a problem), and has continued to lose revenues.
 In 2012, the company lost money compared to where  it was the year
before.We have the company’s fiscal reports
