As the investigation into the “gross negligence” of Hillary Clinton’s
handling of classified material continues, one anonymous FBI agent says

she could be facing 10 years in jail under the Espionage Act.

The Act, according to the FBI agent, requires one who discovers the
negligence to inform superiors. In the case of the alleged mishandling of
classified documents and emails, Clinton would have needed to inform her
only superior, the president, and he stated last week that he was not
informed.

According to the Daily Mail, “Obama said flatly during a ‘*60 Minutes*
<http://www.cbsnews.com/news/president-obama-60-minutes-syria-isis-2016-presidential-race/>‘
interview on Sunday that ‘No,’ he did not know Clinton sidestepped security
protocols with her a home-brew email setup while she was his secretary of
state.” Under conditions of anonymity, the FBI agent stated, “If
investigators conclude that the former secretary [Clinton] was criminally
careless in how she approached the security of the sensitive documents in
her possession, then this part of the law could be used to prosecute her.”

According to the FBI agent, the investigation being conducted by the bureau
centers on whether or not she violated the laws within the Espionage Act,
specifically, “18 U.S. Code § 793
<https://www.law.cornell.edu/uscode/text/18/793#.ViEga36rR1t> – Gathering,
transmitting or losing defense information.” The law applies to “any
document, writing, code book, signal book, sketch, photograph, photographic
negative, blueprint, plan, map, model, instrument, appliance, note, or
information, relating to the national defense’ – even if it’s not
considered classified.”

If Clinton knew that she was in violation of the Espionage Act, she was to
have notified Obama immediately; and according to Obama, she did not inform
the president.

Of course, Obama could use his presidential pardon to keep the former First
Lady out of jail, but Obama has historically not used his presidential
pardon

Obama’s use of the presidential pardon pales in comparison to his use of
executive orders. In fact, according to The Nation, “While in the White
House, Bill Clinton pardoned well over 100 people. So did President Bush.
To date, Obama has pardoned less than two dozen and commuted even fewer
sentences.”

In contrast to Obama’s lighter total of presidential pardons, he has used
executive orders 221 times. In light of Obama’s supposed hesitancy to use
presidential pardon, it seems likely that Obama will not bail her out with
his pen this time.
