Of course the President has sway in such a decision, but the one who makes the determination is the Attorney General. The FBI also has the option of sending over the investigation files with, or without a recommendation.
"IF" the recommendation by the FBI is to charge Clinton, and the Attorney General fails to do so, then according to several "Pundits" who supposedly have "the inside track" to the investigation; there will be folks who will resign, and make it very public why they are resigning. With the amount of investigators that the FBI has on this case, it woould make one believe the old adage, "Where There's Smoke~~~"; somewhere near 150 FBI Agents investigating....
