Comey never presented it to justice as part of the deal Clinton struck with Lynch. More likely the e mails they found paint Comey into a corner. The entire FBI knows Comey tanked the first investigation for Clinton, so now he couldn't cover up these new ones. He is trying to avoid criminal charges being brought against him because nobody could be that incompetent.
