If the police can take custody of your phone to see if you were using it at the 
time of an accident, then they are preventing you from recording after an 
accident... including the police investigation.  It doesn't have to be an 
accident.  Any incident will suffice.  There are Youtube videos of police 
telling people they aren't allowed to record while standing on their own front 
lawn.
Recently, there was an Uber driver who was told to stop recording that "It's a 
new law."  The driver was a moonlighting lawyer and knew better.
And, ultimately, they are could force you to incriminate yourself by taking 
possession of your cellphone.
