Corey, The only reason any legal action was taken against selling the shirts was to protect the privacy rights of the dead soldiers listed on the shirt. If the shirt had only said "Bush Lied... They Died" there would never have been an issue of legality.
But to the bigger question; yes, there were those who faced similar treatment as Benson while opposing Bush, and yes, many received representation from the ACLU and won. This should never happen but it does and it happens regardless of which party is in power.
