In the opinion of much of the public the SCOTUS under the previous chief justice was thought to be too liberal, for instance in the KELO decision. In fact I read a comment by Justice Stevens in which he said after seeing the result of that decision on the people and families involved he thought they might have been wrong in that decision. The public overwhelmingly felt that that decision was totally wrong in almost every detail and took steps to see to it that their states would not do the same thing to the public there. Partial birth abortion is another decision where the public is very much against the SCOTUS decision. Neither of those decisions are brought up at all by this reporter - but what can you expect from the NYT.
