Interesting, although they never contacted me after I reported the issue to them over 3 weeks ago, and didn't respond to a "what's the status" query a few days ago. They certainly haven't replaced the two units I've bought and paid for which are completely unsuited for use with ntp. I suspect "firmware build error" is a euphemism for "bad coding." Note that their response doesn't provide any specifics, such as what period the polls will eventually slow to, if it does in fact slow down, or how it behaves if it receives a KoD packet (mine treats that as if it got a bad response, and _immediately_ polls again). And of course, if it polls every 6 seconds for a minute before slowing down, that's still a ToS violation despite their claim otherwise (although there are also a lot of web sites which advise using iburst with pool servers). This thing is doing something more like sntp, and causes the clock to simply step the time every time a response is received, so there's never a need for multiple successful polls in a short period - nothing useful comes of it.
