In fact, it IS currently available:

In fact, 56 is the only current hole in the syscall numbering scheme between 
1..NSYSCALL that is unused and not reserved.

For this reason, 56 is also the number used in Eric Schrock's pieces on adding 
a 
syscall to Solaris.
