There isn't a specific "paper disposal" requirement in the HIPAA privacy
rule, but the 164.530(c) general safeguards provision is where the issue
arises.  This provision requires appropriate administrative, technical
and physical safeguards to protect the privacy of protected health
information.   The official comments at page 82562, state the
requirement does not prescribe any particular measures, but lists
examples including locking doors or filing cabinets and shredding
documents with PHI.

Your state law, or other federal rules may contain more specific
requirements as well.

Can someone give me the citation in HIPAA where it actually talks about
destroying paper claims. I know it must be there but where is it?

ditto, but we believe pick up is inappropriate - recall scandal of 3 yrs
ago
when the dump truck got in an auto accident and claims flew all over the
highway.  We require an on-site, cross cut (little diamonds rather than
long
strips that can be put back together) shredding service.

and associated records under both HIPAA and their individual states

am aware of the rules for retention, I am more interested in disposal of
paper records no longer needed and the best way to handle them.
