I've asked this question many times. Sometimes of "top" copyright lawyers. In THEORY the proof of copyright ownership which prevails in UK courts should, under the Berne Convention, also hold true in USA courts. In practice no US lawyer will touch a case unless copyright registration has been done in the USA. One has to wonder why the US government signs up to these treaties when they are not willing to abide by them.

France recognises UK law with greater force than the UK does. I have read of three cases where copyright owners have waited until publication occurred in France before going to court in that country. In one instance, I think it was Elliot Erwitt, waited until a plane landed in France with an InFlight magazine on board to prove that "publication" and "distribution" had occurred in France.
