Correct. Could be that the EULA wouldn't stand up to a court challenge, 
but is your client prepared to be the test case?

I got tired of swimming in the murky waters of Microsoft licensing, and 
I got tired of knowingly developing applications that wouldn't work on 
other platforms in the future. So I decided to move away from 
proprietary software, whenever possible.
