Turns out... Up until mid 2010, MacBook Pros defaulted to 32 bit and in order to force 64 bit you hold down ...and I am not making this up... the '6' and '4' keys on start up.
A restart and a fresh installation of j64-804 and all is right in my macbook pro's world. Also turns out that everything is quicker using 64 bit and I even saw one of them new fangled horseless carriages on my evening walk ;-) Cheers, bob ps.
