Presiding Judge Tahsin, sitting on the South Jakarta District Court bench, said the article in Garuda Indonesia, the national carrier's in-flight magazine published by Indo Multi Media, had "ruined the reputation of Hutomo Mandala Putra as a national and international businessman." The judge also said that identifying Tommy as a murderer was irrelevant to the article, "A New Destination to Enjoy in Bali," a review of his Pecatu Indah Resort published in December 2009. "Although the Supreme Court has convicted Hutomo Mandala Putera in the murder case, he has served his sentence and since the completion of the [term] he has fully regained his rights as a citizen and for his past to not be mentioned," the judge said. Tahsin ruled that six entities named in the lawsuit must pay the businessman, who was convicted of ordering the assassination of a Supreme Court justice who found him guilty of graft. Tommy was sentenced to 15 years for the killing but was jailed for just five. The defendants were the airline, the magazine, its chief editor Taufik Darusman, Garuda corporate communications vice president Pujobroto and editors Sari Widiati and Prasetyo Budi, who is also a Garuda marketing manager. The judge also ruled that Garuda must publish a full-page apology in the next three editions of the magazine, although the plaintiff's demands for a mea culpa to be printed in three national newspapers were not granted. Ferry Firman Nurwahyu, Tommy's attorney, said his client was satisfied with the verdict, even though they had sought Rp 25 billion in damages. "We are satisfied. This is a big blow to them. We're happy even though the amount is only this much. What's important is the legal fact was proven, that they damaged my client's good reputation," Ferry said. Garuda lawyer Erry Hertiawan said the court had made a big oversight in the case. "The judge did not consider the fact that the article's translator, Ted Thornton, confessed that he was the one who added 'convicted murderer' in the footnote. The footnote was not included in the original draft, Ted added it himself," Erry said. Agus Sudibyo, a member of Press Council, was reluctant to comment on whether the ruling was a blow to press freedom but agreed that calling Tommy a killer was irrelevant to the article.
