nut, it's included in RHL8.
this was i couldn�t remember.

#vi /etc/ups/ups.conf
[myups]
driver = apcsmart
port = /dev/ttyS0
... and so on
#service ups status
i thought it was powerd :-(

the solution for the second question works with nut:
#upsctr2 -s BATTDATE=12/24/02 myups
and now apcupsd is satisfied
#apcaccess | grep BATTDATE
BATTDATE : 12/24/02
