Dear Omega (I have got no name) Thanks for your mail. It is difficult to understand what it is that you expect your accountant to do for you ? Your accountant is an tax agent and as such has obligations with the ATO. He or she is not equipped to tackle the issues, simple because they have no proof to back up their claim. Your accountant is an important person who can do your books and keep you abreast of your financial situation. ITR are equipped to deal with the ATO should you wish to take issue. Please do not blame your accountant, you can not expect him to bring down an elephant with a water pistol. Dear Omega, The cases referred to by the ATO are 2 cases which had nothing to do with ATO laws. Since actually 2 of the cases before Hayne J were mine I believe that I am in a position to comment. My 15 yr old daughter could reduce Hayne J to tears within 15 minutes tearing his decision apart. To make it worst for the ATO we prefer to use is decision instead and after the decision of the Full Bench of the High Court on 23 June 1999 Sue v Hill, what more can we say. Here the Full Bench, including hayne J, fully reversed the Hayne J decision by declaring the UK to be a foreign power and that no act of that foreign power can be applicable within Australia.
