Hi, Eric:

Thanks for this. I have two references that might support your recommendations that a quick search did not find:

Spencer Graves (2023) "Do copyrights and paywalls on academic journals violate the US Constitution?".[1]

>> ANSWER: The Copyright clause of the US Constitution authorizes intellectual property protection "To promote the Progress of Science and useful Arts": No one writes for a refereed academic journal with a realistic expectation of earning copyright royalties from such articles. In the age of the Internet, paywalls and copyrights on refereed academic journals are obstacles to the progress of science and the useful arts.

Dean Baker (2016) Rigged: How Globalization and the Rules of the Modern Economy Were Structured to Make the Rich Richer (Center for Economic and Policy Research, ch. 5) says more broadly that the results of government-funded research should be exempt from patent and copyright protection.[2]

In my experience, a literature search is never complete ;-) I hope you all find the mention of these two references useful -- and not an expression of egotism on my part, as the author of the most recent of these two references.

Hi all,

It might interest some on this mailing list: Wikimedia Sverige and the Swedish Library Association just published a co-written report on open access to science and copyright. The purpose of the report is to propose a way forward for reaching the aim of 100% open access to publicly funded research. The report is still in Swedish, but we are working on a potential English translation (and I suppose machine translation can do a job too): https://commons.wikimedia.org/wiki/File: %C3%96ppen_vetenskap_och_upphovsr%C3%A4tt.pdf <https:// commons.wikimedia.org/wiki/File: %C3%96ppen_vetenskap_och_upphovsr%C3%A4tt.pdf>

The report will be used to get MPs to draft motions for legislative change, but was also used as the foundation for our input to the EU Commission on a proposed European Research Area Act. There is an open call for evidence open that closes by the end of this day, if any other European affiliates interested in open access questions want to have a say. Here's our input: https://ec.europa.eu/info/law/better-regulation/ have-your-say/initiatives/14608-European-Research-Area-Act/F3713161_en <https://ec.europa.eu/info/law/better-regulation/have-your-say/ initiatives/14608-European-Research-Area-Act/F3713161_en>
