Hi Stefan,

My understanding is that PeerTube instances normally fall into the
Video-Sharing platform definition (Article 1(1), letter aa) AVMSD
<https://eur-lex.europa.eu/eli/dir/2010/13/2018-12-18/eng>) and therefore
the not-for-profit educational and scientific repositories
exception doesn't apply. In order to benefit from the exception, one should
be able to demonstrate that a PeerTube instance is a repository and not a
video-sharing platform, for instance excluding that the platform provider
plays any role in the organisation of the videos. The focus on education
and science does not play a role in this determination.

On the possible exception for small instances, I feel it would be tough to
justify, since, as pointed out by the Commission in the proposal, the size
of an actor is not related to the risk it may pose to minors (enven small
actors can cause harm to minors). This is the reason why there is no SMEs
exception that could undermine the goal of the proposal, i.e. protecting
minors online.

All the best,

Michele
