That would fall under Legal Questions to be addressed by a Lawyer. Often, what seems to be.... is not. VOC REHAB, is a government agency and you need permission from the government to sue it. This is only one of the reasons I've always suggested that one do their homework and leg work before, rather than having to resolve problems after things go wrong. Each state VOC REHAB Program, is covered by an ADVOCATE Program listed in the back of YOJR VR Manual with names and addresses of those advocates. Also, there are no short-cuts to any legal action or legal procedures. That is the way it has always been and that is the way it is. Generally, VR pays vendors in 1/3 payments with the last of the 1/3 when the client have signed off on the received product once all is in place and working. I have tape recordings of most of my meetings (to meet my inability to take notes due to my Difability). VocRehab furnished me a replacement standing wheelchair in 2000. Only to bring the old Levo they declared a LEMON back 9 months later. It was supposed to have been rebuilt with a 90 satisfaction guarantee, WHICH THEY WOULD'NT HONOR! I refused to accept this old chair back, but my counselor, his suprvisor, and a DME I had already written Voc. Rehab, that I didn't want to deal with. Which is written in their handbook as a right we are supposed to have, to decide who we want to furnish our equipment. Threatened me on recording that either I accept this old chair back or they would take both chairs and load tem in their pickup and leave me with nothing.
