Doctor ordered medical procedure protectors those properly trained and  
certified  to perform those medical procedures.  Failure to  follow those 
medical 
orders could place the patient in medical distress.   This could lead to 
another kind of legal action.
 
But the court system being what it is, means that you can be sued for  almost 
anything. In  judge's courtroom anything can happen.... or not  happen.  Up 
to some point its academic until it actually happens.
