Although the court of appeals' decision does not affect any federal statute or practice, the U.S. is a Respondent in the case by virtue of being a (prevailing) defendant in the proceedings below. And Supreme Court Rule 26.3 provides that "[a]ny respondent or appellee supporting the petitioner or appellant may file a reply brief."
