Devvy's Very important: If you live in Texas or know someone in Texas March 14, 2012 From: Devvy's Email Alerts<[email protected]> Date: March 14, 2012 Subject: News Items you might have missed
Devvy http://devvy.com/ Links are generally posted at my web site http://devvy.net/cgi-bin/dada/mail.cgi/r/alerts/552430142037/ ______________ Below is an email I just sent out to the petitioners in our 'smart' meter battle here in Texas . For those who might not know what that is, at the very bottom I have provided links about my case. Networking works. If you live in Texas , your letter will count; see below. If you know someone who lives in Texas , please pass this along to them. Everyone in this country will benefit from this battle we're fighting to get rid of those dangerous "smart" meters. Thank you. Message: Hello to petitioners and folks who wanted to be kept up to date on our 'smart' meter battle. I spoke with Tommy earlier today. Yesterday afternoon he spoke with the Texas PUC's legal counsel. They have been given our petition and opened a new Project No: 40190. The TPUC has to publish our petition in the Texas Register. That was done on March 9, 2012. Of course, the Texas Register is everyday reading for average folks, right? Once the comment period is closed, the PUC then has 60 days to respond. They do not want to give us a full public hearing. The message is clear. The PUC can come back on April 23, 2012, and deny us a hearing. I ask Tommy what happens then? It goes to judicial review. I pray that doesn't happen, but if it does, then we have to take that next step which is heading to a judge to force them to give us the hearing. We absolutely have fulfilled the requirement for a hearing: http://devvy.net/cgi-bin/dada/mail.cgi/r/alerts/582246200857/ (d) Public Hearing. The commission may schedule workshops or public hearings on the proposed rule. An opportunity for public hearing shall be granted if requested by at least 25 persons, by a governmental subdivision or agency, or by an association having at least 25 members. The request for public hearing must be made no later than 30 days after the date the proposed rule is published in the Texas Register, unless the commission establishes a different date for requesting a public hearing. Shall in the law doesn't mean, well, we don't want to. We also submitted 117 signatures with the petition. May I tell you how important this is? U.S. government and state government agencies routinely publish proposed changes in rules and regs. Many years ago we buried the Treasury Dept in comments against the 'know your customer' proposal. Over 220,000 of us sent letters and faxes (most people weren't into email way back then) expressing our objection to their latest proposal. We won. That is how you win going up against regulatory bodies. The TPUC needs to see thousands of Texas expressing their support of our petition. It will make a big difference. Here is the Texas Register for March 9, 2012: http://devvy.net/cgi-bin/dada/mail.cgi/r/alerts/087868126353/ Our petition is just right about at the very bottom. Could they use a more bland title? Notice of Petition for Rulemaking When you click on that Notice of Petition for Rulemaking, it takes you here: http://devvy.net/cgi-bin/dada/mail.cgi/r/alerts/340167742136/ We need as many Texans as possible to write a snail mail letter to the Texas PUC stating the reasons you support a moratorium on installation and a ban on those meters. Soon as I send this email, I'll send another out to my email alert list which has thousands of subscribers. Networking works as we know. I hope you will spread the word to groups and organizations, family and friends and anyone who wants those dangerous meters banned. Every letter will count. I'm going to send off mine tomorrow to their P.O. box. Below is says you can call. Will you call get counted? That's why I'm sending a letter and keeping a copy for my records. Closing date is March 30, 2012 your letter has to get to them by that date. >From the Texas Register's web site: "The deadline to file comments on the petition is Friday, March 30, 2012. Comments shall be submitted to the Filing Clerk, Public Utility Commission of Texas, 1701 North Congress Avenue, P.O. Box 13326 , Austin , Texas 78711-3326 . Sixteen copies of comments are required to be filed pursuant to §22.71(c). Interested persons may contact the commission at (512) 936-7120 or (toll-free) 1-888-782-8477. "Hearing and speech-impaired individuals with text telephone (TTY) may contact the commission at (512) 936-7136 or use Relay Texas (toll-free) 1-800-735-2989. All comments should reference Project Number 40199." I know we can get more than 16 comments submitted. Thank you, everyone. And, thanks to all who sent information regarding an engineer. Working on it.
