It might be possible that the akmod-nvidia fixed to build with 3.8.x kernel was 
not made.
Pre-built kmod are "building fine", so I will try to force akmod to be made and 
push the
result to stable.

thanks muchly I install akmod-nvidia-304.64-7.fc17.8.i686
rebooted and initially nothing but rebooted again and it was good.

BTW I've done this only a couple of times and it seems I have to reboot twice , is that 
because the RPM build didn't finish in-time or it needs to reload the MOD after install?

ie is this normal?

but all good now functioning driver and DVB
