In most cases I would agree, but there doesn't appear to be much doubt in this case. Beard was not a random stop. He was involved in an accident and the policeman working the accident smelled alcohol on his breath. Beard admitted he had been drinking, failed the field sobriety test, and blew a .10 on the BAT. He was also driving on a suspended license. I'm not suggesting CDF throw him off the team. Stallings' handling of Palmer demonstrated that there is some wisdom in giving a young man a second chance. But Beard should receive some punishment.
