The Story
~~~~~~~~
The NCAA's Worst nightmare seems to be coming true. When they slammed
Alabama with a two-year
bowl ban and placed severe scholarship limitations And stated that Alabama
was "staring down the
barrel of a gun" at the death penalty the NCAA thought everybody would just
bend over and take it As
usual. That Probably would have happened, But Up in Memphis Tennessee The
Feds convened a
Grand Jury to indict Logan Young accusing the Prominent Memphis businessman
of conspiracy, crossing
state lines to commit racketeering and arranging bank withdrawals to cover
up a crime. This However
was there ultimate demise.
After more than 2 years Logan Young's attorney's (Jim Neal, the former
Watergate prosecutor)
finally won A huge victory when the judge Declared that All of The
documents, (which the NCAA had
argued to keep sealed) used by the NCAA in the Investigation Of Alabama be
made available in late
December 2003. As a side note the day that the sealed NCAA Documents and
tapes had to be turned
Over the NCAA sent a letter to the University of Alabama stating that no
further sanctions would be
forthcoming concerning the Memphis case; Which they had left open since 2001
in case something new
came out in the Memphis Case.
In all of these papers one dated May 23 2000, Phillip Fulmer Alleges in a
sworn Statement as
a Secret Witness to The NCAA Lead Investigator Rich Johanningmeier of
Numerous NCAA Violations by
Mike Dubose, Bear Bryant, Shaun Alexander, Ivy Williams, Ronnie Cottrell and
the University of Alabama,
Auburn, Kentucky, South Carolina And Georgia. For this Co-operation
Tennessee was granted a pass
on violations by UT Football And Athletic Department. Did Fulmer have a
vendetta to go out and destroy
Alabama's Tradition and try to put a death nail in the Alabama Program?
Well, you look At the evidence
and tell me what you think.
NCAA's investigation into Alabama football and the role Fulmer played.
~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~
1) In the fall of 1999 Tennessee coaches were quoted as saying "Alabama will
be out of business
in 2 years." Guess what? Milton Kirk started brazenly auctioning Means off
in less than 4 months.
Does it not make sense that they KNEW what was about to transpire?

2) Phil Fulmer will sneak around and try to dig up dirt on opposing teams.
He did it with Alabama.
Tommy Gallion has the written evidence and affidavits signed by ex-UT
players that he did this. That
is a documented FACT.

3) There is NO DOUBT that Lynn Lang (Albert Means Former High School
Football Coach & FBI Witness)
shopped Means. But to who? At least 5 other coaches testified that he had
shopped Means to them.
Ivy Williams didn't. Ivy Williams testified that he was not presented with
the auction. That is because
Lynn Lang didn't pitch the idea to him because he knew It would have scared
Bama off.

4) Lynn Lang was found with unexplained money That is a documented FACT.
He initially never said where it came from This is a Fact as well. HE COULD
NEVER ACCOUNT
FOR THE $115,000+ in payoffs and/or The Feds couldn't find it, Fact. You
can't make that kind of money
go away without a trace. The feds know how to track it down or find evidence
of it.

5) The US attorney in Memphis, Tennessee filed a 13 count "slam dunk"
indictment. When
Fred Godwynn The Memphis Federal Prosecutor did this Cleo Kirk (Milton
Kirk's Older Brother & Memphis
Council-Man) eventually persuaded him that Logan Young was the Key and the
Feds gave Lynn Lang
and Milton Kirk a CUSHY deal, removing the 13 count "slam dunk" indictment
to a plea bargain (with no
Real time served).

5A) Could Karl Schledwitz have paid Lynn Lang to send Albert Means to
Alabama? He is a
mover and shaker in high circles in Tennessee. He is lawyer. He was involved
in a banking scandal
(money going where it was not supposd to go) and he had access to money then
in his venture
capitol business. He is friends with Fulmer. Gallion mentioned that he was
connected to Fulmer.

6) Mysteriously, the slam-dunk case against Lynn Lang was dismissed in favor
of a plea
bargain that would let Lynn Lang walk. The case was dropped and a deal made
because the trail
led somewhere it shouldn't have, or there is no money. That is a documented
FACT.

7) Lynn Lang and Milton Kirk received a plea bargain that would let him walk
That is a FACT.
If he said "UT paid me to set up Alabama" or "There is no money", a MASSIVE
bomb would go off against
him and the Memphis crowd. But as soon as a deal was presented that would
let him walk, he suddenly
remebers that Logan young (A Falsely Accused UA Booster & Prominent Memphis
businessman)
paid him the money.

8) Alabama's NCAA case eventually centered on Logan Young's involvement in
an alleged
scheme to sell the services of Memphis High-School star Albert Means to
Alabama during the recruiting
season of 1999-2000. Not one piece of evidence, Not one check, not one
receipt, no bank records,
nothing in over 2 years of Federal Grand Jury testimony in the Memphis case
has ever been able To
be shown as proof that any of these allegations are true. The NCAA punished
Alabama; they did this
at the request of Philip Fulmer, with no Proof, just the word of admitted
liars. All parties in The case
against Alabama has Direct Ties to Tennessee or Fulmer. NONE of their
Allegations can be proven
in a court of law.

9) Phil Fulmer repeated Alegations that he had NO CLUE as to whether it was
true or not, with
the intent of hurting another SEC school. That is a documented FACT. Rich
Johanningmeier took confidential
testimony and forwarded it to the Committee on Infractions and INTENTIONALLY
hid the identity of the
source from the University of Alabama in VIOLATION of NCAA ByLAW 32.7.5.5.1
To make it worse,
this confidential testimony was hearsay testimony from ANOTHER confidential
witness.
THIS IS A DOCUMENTED FACT.

NCAA to review
Tennessee records

KNOXVILLE, Tenn. -- An NCAA enforcement officer who cleared Tennessee of
academic
wrongdoing in March plans to review records an English professor said reveal
questionable practices
to keep athletes eligible, The Tennessean reported. Linda Bensel-Meyers said
the NCAA has asked to
review her records. She said those records show that athletes often were
steered toward easier
majors and even had their grades changed.

On, or about, March 9th, Phil Fulmer, 3 assistant coaches and Rich
Johanningmeier had a meeting. There
may be some evidence to suggest it was related to the above-mentioned
"clearing" of UT by the NCAA
Enforcement officer. This is being investigated. Stay tuned for details

11) http://venus.soci.niu.edu/~archives/TOMPAINE/apr00/0516.html

Ron Barker, a member of the NCAA's enforcement staff, notified university
general counsel
Ron Leadbetter that he will return to campus May 23 and meet with
Bensel-Meyers, the newspaper
reported in today's editions.

Were you aware that Phil Fulmer met with an NCAA rep to give his first
confidential witness testimony to Rich
Johanningmeier on ....May 23rd?

May 23 2000, Phillip Fulmer Alleges in a sworn Statement as a Secret Witness
to The NCAA Lead
Investigator Rich Johanningmeier of Numerous NCAA Violations by Mike Dubose,
Bear Bryant, Shaun
Alexander, Ivy Williams, Ronnie Cottrell and the University of Alabama,
Auburn, Kentucky, And
Georgia. For this Co-operation Tennessee was granted a pass on violations by
UT Football And
Athletic Department. In Johanningmeier's Interview summaries, the
investigator wrote in all capital
letters: "Fulmer should be regarded as a confidential source of information
and this Memorandum
should not be included in any custodial arrangements that could be made in
the
future with the University of Alabama, Tuscaloosa."

UT Coach and Tom Culpepper Met at the Hula Bowl initially, where Tom
Culpepper said he wanted to
help bring down Alabama then With his lawyer's advice, Fulmer secretly
recorded 90 minutes of an
eight-hour conversation with Culpepper in Chattanooga during The summer of
2000 in which Culpepper
discussed information he could provide regarding NCAA rules violations at
Alabama.

1) According to Johanningmeier's interview summaries, Fulmer said a friend
of his who worked with
Game Day Centers, a group out of Opelika that Developed condominiums near
college football stadiums,
had information pertaining to former Alabama running back Shaun Alexander
and a Dr. Porch. The friend,
according to Fulmer, said Porch's daughter told him "that her family was
looking forward to being assigned
another Alabama Football student-athlete" after enjoying a close
relationship with Alexander.
Response To a Local Newspaper:
Sandra Porch Nesmith, an elementary school teacher in Arab and the daughter
of Arab physician
and long-time Alabama supporter Dr. Ellis Porch Sr., called Fulmer's
statement "absolutely absurd."
"My daddy has always been very active in the First Baptist Church and our
pastor was always
looking for ways to get the youth more involved In church," Nesmith said
Thursday. " Daddy
went through the university to get some players to come speak to our church.
"Shaun came up
with (former Alabama quarterback) John David Phillips and spoke. Shaun spoke
a couple of
times, including at our fifth-grade D.A.R.E. graduation, and he would come
to our house when
he did. But daddy was always very careful to ask the people at the
university to Make sure
nothing was against the rules. "I never said anything about a player being
assigned
because nothing like that ever happened. That's just a bold-face lie."

2) Fulmer also told Johanningmeier that Culpepper could provide information
to the NCAA on several
fronts against Alabama. Some of which are:

-- Arrangements were made to pay Alexander to play his senior season of
1999;

-- Arrangements were made to obtain a fraudulent ACT score for former Tide
player Harold James;

-- A person who monitored standardized tests was paid by Cottrell to ensure
that prospects being
recruited by Alabama would receive qualifying scores;

-- Young paid part of the cost of Cottrell's home and was providing Cottrell
with cash payments;

-- Arrangements were made to pay for Santonio Beard, a former Tide player,
and Mac Tyler, a
former Alabama signee, to attend Milford Academy.

-- Young used casinos in Tunica, Miss., to withdraw sums of untraceable cash
to buy football prospects;

-- Young had made payments for seven years to Memphis Melrose High School
coach Tim Thompson
to deliver football prospects to Alabama;

-- Cottrell was involved in helping obtain Tide signee Michael Gaines'
fraudulent ACT score.

-- Arrangements were made to provide a loan to Terri White, the mother of
Alabama football player
Justin Smiley.

Immediately afterward, on May 24th, Fulmer has an interview with Paul
Finebaum in which he lies through his teeth
about his (supposed) knowledge of Alabama violations and the manner in which
he says he wouuld handle it.

The NCAA case concluded with a Feb. 1, 2002 NCAA Committee on Infractions
report in which
chairman Thomas Yeager said Alabama was "staring down the barrel of a gun"
at the death penalty.
The committee imposed a two-year bowl ban on the Crimson Tide, which
concluded in December,
and placed severe scholarship limitations on the football program that end
next month.

Just last week, the NCAA sent a letter to the University of Alabama stating
that no further sanctions
would be forthcoming concerning the Memphis case.

A federal grand jury returned a three-count indictment against Logan Young
last October,
accusing the prominent Memphis businessman of conspiracy, crossing state
lines to commit racketeering
and arranging bank withdrawals to cover up a crime. This case has still not
been brought to trial. There

Gallion and Shanks have been poring through more than 7,800 pages of
documents and
hundreds of hours of tapes related to the NCAA's investigation of Alabama,
including interviews between
Johanningmeier and Fulmer.

"(The NCAA) had to know the case was built on malicious falsehoods," Shanks
said.

Cottrell's lawsuit is asking for $15 million in compensatory damages and $45
million in punitive damages.
