I have to disappoint you, _every_ implementation suffers from the fsmlabs 
patent, including RTAI/LXRT (unless your outside the USA, because the patent 
is only valid in the USA). From the point of view of licenses and royalties 
there is no difference between RTLinux and RTAI, you always have to deal 
with FSMLabs.
