OK so you can set and view ACLs using setfacl/getfacl ('setfacl -m d:o::rwx /tmp' 'getfacl /tmp' ? ie the kernel patches worked successfully ?)
If so then ACLs are indeed enabled. I would then start the compilation afresh - Samba should pick up on the ACLs automatically. Are you using winbindd for authentication ? A caveat to remember once you are up and running with ACLs is that only the owner and root can alter ACLs through the Windows Explorer editor.
