Does this permission to you pre-date his adoption of the Common Creative License? If so you may still have rights to release your instance of the code under the GPL. In the meantime, if having the files hosted on Savannah make you uncomfortable you can delete the files via CVS. I played on a game which used it. I asked to him the right to put Talesta on a website like sourceforge because many people developp alone on it, and I would unify this. He gave me his agreement (at that time, Talesta had have no license).
