You can do the second point, add file that stated that OpenSSL have incompatible licence with GNU GPL. This is possible because of the GPL exception. Check out http://www.gnu.org/licenses/gpl-faq.html#GPLIncompatibleLibs In order to release your project properly and unambiguously under the GNU GPL, please place copyright notices and permission-to-copy statements at the beginning of the Makefile. For more information, see http://www.gnu.org/licenses/gpl-howto.html. The GPL FAQ explains why these procedures must be followed.
