Actually, I cannot reproduce this. I've run the attached ImplicitTest against trunk and the code base of 1.4.4 with Sun JDK 1.5/1.6, Oracle JDK 1.7, iceteabin-6/7 and IBM JDK 1.5/1.6. The test never failed once and the test compares on top the generated XML as well as element structure.
