RE: other companies and developers to watch out for

2011-02-04 Thread Blake Helppie

This is better than a Mexican soap opera...

Something that apparently few people on this forum know is that it is
practically impossible in the United States to successfully pursue legal
action for "Libel." I haven't even read what Michael purportedly wrote,
which is being considered "libel," but I would advise that any legal
fees spent on pursuing a case of libel are wasted funds.

On another note, I just confirmed today that our company is now looking
to recruit a mid to senior level CF developer to work on our CF9 dev
team. Importantly, this person would need to relocate to or be in Troy,
Michigan...where you can live like Carlos Slim (going on the Mexican
soap opera theme) on the salary of a Carl Smith.

Re: other companies and developers to watch out for

2011-02-04 Thread Michael Dinowitz

Guys,

I was busy with a funeral for my young cousin and didn't come down on this
thread like I should have. One word here:

STOP

Stop with the fighting, the threats, the personal attacks, the various
actions that have caused some people to leave this list. Stop now or I'll
start banning people left and right. I'm trying to provide a resource for
the community but if all it does is lead to flames and all then I'll just
drop this list.
I don't want to but all of this is harming much more than you, it's harming
me, your fellow community members, and the ColdFusion itself. If people do a
search for ColdFusion jobs and sees the stuff that's coming up on this list,
they'll run for their lives.

I'm going to ask this one more time. Lets keep this professional.

Thank you

Michael Dinowitz

Michael,

I have no interest in further discussion with you. I hope your retraction
is sufficient to eliminate any harm to me or my company that your libelous
posts may have created. I have no desire to cause you harm - and never
attempted to. I doubt you will hear from me further in any capacity, legal

question by someone, I expect you will take prompt action to assist
remedying it in the future as well.

In the meantime as a fellow person I wish you well and hope you can get your

Really? Now you're REALLY going to quit the list? Sorry, I couldn't resist.
I'm sorry, Michael, for your predicament, really I am, but why do you insist
on posting about it here. Do you think that is going to engender some legal
advise? Ok, here's some legal advice - get a lawyer and stop posting here.
Every time you post you open yourself to further legal attacks. Do yourself
a favor if you are capable of listening to reason please stop posting here
for your own good. So many here have ernestly suggested this course and yet
you keep posting. Why? Is it an obsessive addiction to post, or is it
because you feel like by doing so you will get someone to offer help? As I
indicated before, I never post here because I rarely see much going on, but
this particular thread seems to be immortal, and it's not just your fault,
but all of ours. On the other hand it is also entertaining, albeit in a
sick highway-accident kind of way. I hope it ends up just to a fender
bender in the end and no one gets seriously hurt. Lawyer up, Michael, try
the Legal Aid Society if you can't afford one on your own, they will do
stuff pro-bono...

Michael,

Please keep in mind that future employers might Google your name and find these
forums. I currently work for one of those companies you have mentioned
several times in your rants. I do feel that you need to step back and think
about the potential consequences before making posts to any forum that is open

Please consider this a retraction of my previous statement and an apology to
those who feel they have been harmed. Under the threat of legal action I
cannot bear to put my family through that, so I must ask those who feel such
steps are necessary to call it off and consider this my full apology.

Also, let be noted that I have filled out a contact form request to remove me
fully from this list because I wish no longer to be a member. This was done
yesterday prior to the thread in questioned, but yet I am still waiting.

There will be no more and that is a guarantee.

Re: other companies and developers to watch out for

2011-02-03 Thread Michael Firth

Please consider this a retraction of my previous statement and an apology to
those who feel they have been harmed. Under the threat of legal action I
cannot bear to put my family through that, so I must ask those who feel such
steps are necessary to call it off and consider this my full apology.

Also, let be noted that I have filled out a contact form request to remove me
fully from this list because I wish no longer to be a member. This was done
yesterday prior to the thread in questioned, but yet I am still waiting.

There will be no more and that is a guarantee.

Re: other companies and developers to watch out for

2011-02-03 Thread John Lyons

Okay this post is going against my better judgment, but here it goes:

Mr. Kane, If I understand your email correctly, you are going to sue
someone who has been without work for at least a month that I know of
for libel. What kind of damages are you trying to recoup? Even if your
awarded how will you collect? The individual has already screwed
themselves out ever getting gainful employment via cf-jobs and your suit
would just further marginalize them into desperation.

With that said I have had several very good interactions with cf-jobbers
both personal and business. At heart I think we a good group of people
slow to anger and eager to help out. I hope we can remain the civil
goodhearted folks I've known since joining.

Mr. Firth, back away from the keyboard and cf-jobs. Think about what you
want accomplish with your words. consider an apology and then
volunteering your time on an open source project , blog about what your
doing with them and focus on your studies. IMHO you need to rebuild your
reputation and respect with this group of folks ad the coldfusion
community at large.

Re: other companies and developers to watch out for

2011-02-02 Thread Levi Wallach

I find it fascinating watching these exchanges take place. I used to code
with Cold Fusion way back (99-'02) but haven't touched it since, but somehow
remained a member of jobs-talk, but not of the general CF-Talk, probably
because this list gets generally little traffic. So I guess I am getting
only half of the conversation. It's obvious to me that Michael has annoyed
a lot of people and doesn't seem to care, but at the same time other members
are so affected by messages that otherwise seem benign, that it seems the
whole situation has devolved into one that isn't on a professional level but
a personal one. I wonder, whatever your opinion of Michael is, what good
does it do to vent about it in a public forum, other than to blow of some
steam (while at the same time presenting an unprofessional/negative aspect
of your own demeanor)?

Being on the Internet for abour 20 years now (and BBS's before that) has
taught me a few things, some of them certainly useless, but a couple of them
hopefully more useful. One is that it's hard to guage the tone of someone
and easy to misunderstand meaning online due to lack of body language, etc.
Because of this I always try to assume the best of intentions. Even if it's
hard to see those positive intentions, I often try to keep from responding
immediately myself if my reaction is strong and negative. Waiting until that
initial emotional reaction has subsided, I can often think much more clearly
and respond in a way that is more constructive than reactive.

This is not to say that Michael didn't act unprofessionally, but some of the
reaction seemed to be just as unprofessional. I did not see most of his
messages on this list (cf-jobs-talk) that I can remember, but if I was
seeing them on another list and got annoyed, I'd have either - 1) written
the moderator to express my concerns, or 2) sent Michael a private note
to express my concerns. Many of you may have done these things to no avail,
but my final approach would have had 100% success: 3) create an email
rule/filter to remove his messages. It's amazing to me that despite
filtering technology like this being around for 20+ years, that ppl would
still rather get into long arguments than simply opt out of a certain
person's messages or discussion topics. This on a forum of highly
tech-savvy folks.

Since none of you probably recognize my name, it should be evident that I
never post on these lists, and probably won't again for a while if ever, but
something moved me to post about this (and perhaps I'll regret it later), so
that perhaps some perspective from a semi-objective party might be useful in
some way to a few of you. I know there's some irony in the fact I'm
suggesting people not speak out here about these things and then doing just
that, but just know there have been incidents in the past that I've
considered commenting on but haven't, so pershaps this is just my one 'gaff'
that proves my general practices are better than this exception ;-) This is
really the first time if not ever, than in many years (and memory) that I
recall posting about an issue like this. I certainly understand annoyance
at unprofessional behavior and just idiotic behavior, but I also have
experienced a lot of real-life passive aggressive stuff so I sometimes
wonder whether some of the vitriol I see online is due to people who feel
powerless (or make themselves powerless) to do something about situations in
real life that they are annoyed at/offended by/etc. and so this gets
transferred to a place they feel a bit more empowered to speak out? Or
maybe that's just pop psyche BS, who knows.

Anyway, I'll shut up now and hope no one takes this personally (although I'm
a bit pessimistic :-( ).

Michael,

Please take this to heart, try keeping quiet for a while. Your current
behavior is not doing you any favors..Trolling the CF lists and
spamming CF-Jobs does not help with your case any. then lashing out to
some who are actually trying to give you some good advise show's
you're hitting rock bottom. Don't make it worse by proceeding to dig
deeper. Take a break for a week or two Use justcoldfusionjobs.com,
monster.com, dice and newspapers for a while. Just give this list a
rest for a while.
