PRESS NOTE

Mr. Shantaram Naik Ex-M.P. and former President of Goa PCC said in a
statement issued today that Mr Manohar Parrikar, Ex-Chief Minister, has to
be exposed by the present administration of the Goa Governor for introducing
a fraudulent pre-employment scheme, deliberately knowing it to be a false
and impractical exercise.

The new administration should, while assuring the victims of Mr. Parrikar's
rash and negligent act, should not allow itself to be put in the dock and
instead , without mincing the words, inform the youth as to a how a head of
the Government tried to fool them for the last one year.

In fact, it is a tragedy that  those who are likely to suffer after the
hollowness in the scheme became known, and as a result of which the Governor
had to put an end to the Scheme, are seeking relief from the Governor under
the leadership of Mr. Parrikar who is himself the culprit in the matter and,
against whom, a prima facie case for u/s 418 (cheating with knowledge that
wrongful loss may ensue to person whose interest offender is bound to
protect) and 120-B (criminal conspiracy ) of the Indian Penal Code is
clearly established.

Mr. Naik said Mr. Parrikar's act can be compared to a number of cases which
we across daily in Goa wherein bogus recruitment agents lure young boys in
the State to apply to them promising jobs abroad, with, ultimately, agents
turning out to be frauds. In this case of pre-employment fraud, it is as if
the agent himself pleading the case of his own victims with other
authorities, to divert their attentions from his own fraudulent and dubious
acts, Mr Naik adds.

It is again, Mr. Naik says , in a criminal offence involving murder,  the
very murderer accompanying the police all the time during their visit to the
site pretending to help the police, ultimately turning out to be the
culprit. It is a case of Chor Machaye Shor, he said.

Mr. Naik said that the Congress Party had warned the people from day one
that the scheme was a bogus scheme as the existing limited potentiality of
the job opportunities in the State Government, was known, even to a child in
the street.  It is like a cinema theatre owner selling tickets even after
the show is full, he said.

Mr. Naik , citing another instance, said,  Mr Parrikar tried to play with
the destiny of the thousands of Goans , the specially people from weaker
sections of the society, by introducing Ambedker Awas Yojana when, the then
BJP Government had neither any land in their possession for allotment, nor
had they identified any nor were they aware as to how much land would be
required for the purpose.

BJP LEADERS SIPHONED OFF 1000 CRORES IN FOUR YEARS

Mr. Shantaram Naik Ex-M.P. and former President of Goa PCC said in a statement 
today that in the last 4 years of  BJP rule, BJP leaders have siphoned of and 
pocketed more than  1000 crores of public money out of the development funds 
through kickbacks, by artificial tender amount inflation, by  tendering 
contracts to fake companies, by adopting fraud procedures like expression of 
interest and , by approving sub-standard constructions for monetary 
considerations.

Mr. Naik said that on every development  project, BJP leaders ensured a cut of 
minimum 30% through various modalities and, some of the projects were 
undertaken more for the purposes of cuts and commissions than for the benefit 
of the people.

Mr. Naik said that according to him around 50 major  cases involving offences 
of criminal breach of trust, cheating, forgery ,misappropriation  and not less 
than 200 other cases of the same nature involving lesser funds and smaller 
properties  will be discovered if 4 years of  BJP rule , is examined  
objectively and  scrutinized with standard methods of calculations and 
accountancy.

Mr. Naik said that the new Government should not only order CBI inquiry in 
each of such major cases but, should also,  constitute a Commission of Inquiry 
with broad terms of reference to inquire into the functioning of the 
Government  in violation of constitutional provisions, local statutes and 
business rules of the government and for  suggesting  ways and means for 
providing an in-built mechanism to thwart defiance of rule of law on the part 
of an administration.

Mr. Naik said BJP's theory  of Power through vitamin M made the party and 
their leaders go on a spree to achieve their  'goals' and 'extract' 
vitamin 'M', left and right. However, BJP leaders were shrewd enough to 
distract peoples' mind from their own black deeds by making corruption charges 
and instituting inquiry commissions against congress leaders, Mr. Naik said.

Mr. Naik said that BJP invested as many as 90 lakhs to buy centrally air-
conditioned office premises for their party to bring in some sort of 'purity' 
in their deeds by saying that they spend their booty for the party , when in 
fact, what is spent for party assets or activities is only a tip of the 
iceberg.

Mr. Naik said that the object behind former BJP government undertaking  
constructions like new patto bridge, constructions on the banks of mandovi 
river and constructions like  multiplex, illegally, in defiance with 
construction and environmental laws was that,  the BJP wanted to make  hay 
when sun shines and, therefore, perhaps might have thought that  if they were 
to wait  for procedural formalities, the scope for commissions would get  
minimized. 

Mr. Naik said that the former Chief Minister Shri Manohar Parrikar's another 
venture is going to be a saffron daily to be published from Panaji in the next 
few months . This daily's objective is to project Mr. Parrikar's image to the 
extent of giving an impression to the BJP workers that without Mr. Parrikar 
BJP does not exist in Goa, Mr. Naik added. 

Whether BJP is able to see the game-plan of Mr.Parrikar, time alone will 
indicate, Mr. Naik added.

Mr. Shantaram Naik Ex-M.P. and former President of Goa PCC said that the BJP 
President and  former Home Minister Shri L.K. Advani has no moral right to 
speak of the so called violation of the Constitution by the Goa Governor when 
Mr. Advani himself was charge-sheeted for violating the entire  crux of the 
constitution  for  his involvement in the demolition of the Babri Masjid.

Mr. Naik said that BJP  leaders like Mr. Advani,   time and again have  
violated the golden principle of secularism enshrined in the constitution by 
instigating people on religious and communal grounds, and that, their hatred 
towards minority community in this country is quite notorious . They have 
never shown any respect to the Constitution of India and therefore, Advani's 
expressing concern for the  provisions of the Constitution, is nothing but a 
case of devil quoting scriptures, he said.

Mr. Naik,  referring to  Mr. Murli Manohar Joshi, former Union Minister for 
Human Resource Development , who, he said,  also talked of constitutional 
niceties , during his recent visit to Goa in connection with BJP's Jamir 
Hatao agitation, said that when Mr. Joshri wanted to play fraud against the 
entire history of the country by saffronising education and by eulogizing  
Nathuram Godse and denigrating Mahatma Gandhi, have no business to talk of 
political morality. If Joshi had survived as a  Minister for Human Resource 
Development, he would have more damage to the country by his notions  than the 
terrorists have done in recent past, Mr. Naik said.

Speaking of BJP leader and former Union Minister for Petroleum Mr. Ram 
Naik ,   Mr. Naik said that it goes to the 'credit' of Mr. Ram  Naik for 
having  'gifted' to the nation the   biggest scam of NDA regime , namely, the 
Petrolium Scam,  in which , thousands of Petrol Pumps were given to BJP 
cronies illegally, unconstitutionally and immorally  through corruption, 
nepotism and favouritism . Where was Mr. Naik love for constitution gone when 
he was giving birth to that gigantic scandal, Mr. Naik questions.

Mr. Naik said those who propose to invoke provisions of Constitution should be 
ones who have proved their regard for its provision . Mr. Naik said during the 
last ten days BJP leaders who descended down on  Goa, were most unfit to give 
lectures to Goans on constitutional provisions, he said.

Mr. Naik said that it is well known fact that  BJP's ultimate goal is not to 
have rule in the country as per the  provisions of the constitution  but, 
their dream role for the country to scrap the constitution, throw it in the 
dustbin of history and have a fascist rule headed by BJP, Viswa Hindu 
Parishad, and RSS.  And, still,  these are the people who swear by 
constitutional provisions, Mr. Naik wondered.

How much Goa has lost by way of developmental projects, with the Goa
Government having invested Rs 30 crores (Rs 300 million) to build cinema
theatres (multiplex), in Panaji Goa, when no Chief Minister of any State in
our country would ever do so at the cost of much needed investments in
health, sanitation, education, electricity roads etc?

With thirty crores rupees, the government could have built an hospital like
Victor Apollo in Margao which was erected at a cost 20 crores only.
Government could have constructed 600 Primary Schools or 500 health centers
or more than 200 kms of road at the same cost of 30 crores.

A chief minister who does not understand the basics of priorities in a
developing country, must be rated No 1 from the bottom in any performance
evaluation exercise and Goa Chief Minister, perhaps may achieve that feat,
soon.

Those who get carried away by the glitter of multiplex at Panaji fail to
understand that the project has not only robbed poor and middle class Goans,
but that, their loss has been doubled as the project, ordinarily could not
have cost not more than 15 crores.

To complete the process of participation of the Goa Government by way of
investment of public money in an unprecedented manner in an uncalled for
project, the Chief Minister should now post his ministers as ticket-checkers
at the four theatres in the multiplex building.

JUDICIAL INQUIRY INTO HOLLYWOOD TRAGEDY TO UNEARTH PRESSURE POLITICS

Mr. Shantaram Naik Ex-M.P. and former President of Goa PCC has demanded a
judicial inquiry into the incident of fire which engulfed Holyhood theatre
at Osia Multiplex , Margao on Saturday afternoon.

Mr. Naik said that the pressure politics involved in the matter can come to
light only through a judicial inquiry.

Mr. Naik said that the matter assumes significance as District Magistrate
had given licence , that too, a joint licence to M/S Osia Multiplex for two
threatres Bollywood and Hollywood although , Director of Fire Emergency
Services refused to give NOC to the premises on grounds that there were
neither Passive Fire Protection measures nor any active Fire Defence system
in the building and further, it did not comply with the width of staircase
stipulated in National Building Code,1983 besides on other grounds.

Mr. Naik said if the theatre was to catch fire after the inauguration of the
theatre on 10th November, hundreds of spectators would have died a tragic
death.

Therefore, Mr. Naik said, those who are directly or indirectly responsible
for criminal negligence, should be prosecuted by the police ,immediately,
without falling pray to the pressure by higher-ups.

Mr. Naik said that Congress as also NCP had pointed out to the Government
about the illegalities involved in the construction of Panaji Multiplex
Building but, the Chief Minister Shri Manohar Parrikar personally attended
the Panaji PDA meeting to grant NOC to the project.

Mr. Naik in his statement further says that the M/S Osia Multiplex did not
make any application for building a permanent cinema building as required
by and under Rule 17 of the Goa Cinematograph Rules 1965 and had applied
straight away for licence to exhibit films.

Mr. Naik said that  the District Magistrate on 1st November has given
license to M/s Osia Multiplex for Cinema threatres in a building which was
never built or intended to be a theatre. Strangely also, one common licence
has been given to both the theatres

Southern Planning a Development Authority or the Margao Municipal Council
cannot give a licence to build a permanent cinema building under Rule 17
of the Goa Cinematograph Rules 1965 for which separate application to the
District Magistrate is a must.

It is not known whether the District Magistrate had visited the site before
giving license . Had it been so, Mr. Naik says, many objectionable things
would have been noticed by him. Since the magistrate has also not mentioned
of his any visit in his order dated 29th October, 2004 , which preceded the
giving of licence in Form 'D' as required by law, it is presumed that there
was no such visit.

When the Magistrate was dealing with a question which concerned life and
death of the cine-goers, it was the bounden duty of the Magistrate to verify
the things and make a report with respect to the same, Mr. Naik says.

Besides, it was not clear as to why the Judgement dated 29th October is in
the name of Additional District Magistrate whereas the Form D was signed by
District Magistrate. Under the Act, Licensing Authority is Distrrict
Magistarte but the government can specify any other authority as District
Magistrate for the purpose but there has to be a notification which should
referred to in the document of License, Mr. Naik said.

People of Goa are now anxious to know whether the Chief Minister is going to
attend the inauguration ceremony of other theatre Bollywood, which escaped
the tragedy, on 10th November as claimed by the owner of the theatres
disregarding life and safety of citizens.
