Wrong to understand a Layer with Name.
If a layer has some sublayer , arcgis call the sublayers but skip the
layer himself
This happened both case with name and without name.
So arcgis think that a layer is alway

If you just want to make the black disappear you could use
MAP
IMAGECOLOR 255 255 255 #set map's background color to white
LAYER
TYPE RASTER
OFFSITE 0 0 0# make this color (black) of the input raster file
transparent

Perhaps you just do it somehow wrong. Show your PROCESSING line and try
meanwhile something like
PROCESSING "LUT=0:255,1:1,255:255"
I haven't tried it myself, this is mostly a guess.
