Crisis today hit the government-appointed committee constituted to draft the
new disability law, with one of its seven disabled members quitting in
protest against the committee’s indifference to its mandate. Others have
threatened to follow suit if their voices were ignored.

Rajiv Rajan, a Chennai-based disability activist, suffering from cerebral
palsy, today tendered his resignation to Sudha Kaul, chairperson of the
committee, alleging lack of democracy in the panel and complaining against
the committee abandoning its mandate by going ahead with “One Disability Law
Code” comprising six separate laws on the sector.

Constituted on April 30 by the Ministry of Social Justice and Empowerment,
the committee was given four months to rework the existing Persons with
Disabilities Act 1995 and draft one comprehensive disability law with the UN
Convention on the Rights of Persons with Disabilities (UNCRPD) on mind. The
idea was to have one law.

In his resignation e-mailed today, Rajan says, “I don't go with many things
the committee is doing. The most important being the direction given to the
legal consultant to go ahead with the disability code work. The concept of
comprehensive law is being misunderstood by most committee members. There’s
fear the committee would divide the sector instead of uniting it. I don’t
see any possibility of passing five-six different laws at one go.”

India ratified the UN Convention on Disability in 2007 but has since failed
to frame a new law. The Committee, eight months since its inception, is
nowhere near completion, with the chairperson seeking a third extension this
month. Its earlier deadlines expired on August 30 and October 30.

When contacted, Kaul said she was abroad and didn’t know of any resignation.
“I haven’t checked by e-mails,” she said.

Meanwhile, other disabled members of the committee also slammed the “One
Disability Law Code” proposed to have six laws on disability rights,
disability rights authority; National Trust Authority; Rehabilitation
Council of India Authority and the Mental Health Authority.

“This is unacceptable,” said Shyamla, a member. The Code is learnt to have
been proposed by Amita Dhanda, law professor at NALSAR University of Law,
Hyderabad.

five separate laws that will be difficult and confusing to implement," he
said. The activist said he had tried to explain this to the committee over
the past few months but as they were not open to his suggestions, he quit in
protest.

The Centre's foot-dragging on enacting a new law to give effect to the UN 
Convention on the Rights of Persons with Disabilities is inexplicable, 
considering
especially that India was among the earliest to ratify it in 2007. First, the 
administration toyed with the idea of amending the existing 1995 Act, while
the stakeholders pointed out that the Convention marked a big change in 
fundamentals and that compliance with it warranted a new legislation. For 
instance,
the definition of 'disability' stands enlarged to cover all long-term physical, 
mental, intellectual, and sensory impairments that hinder equal and effective
participation in society. This requires extending legal protection to 
categories not covered by the existing law and specifying in the statute all the
fundamental rights and freedoms the disabled are entitled to under the 
Convention.

Then, in April this year, a committee was constituted to draft a new 
legislation and it was asked to give the report in four months. It soon ran 
into trouble
over the question of giving due representation to all the stakeholders in 
keeping with the motto "nothing about us without us." Now, the panel has sought
time until March to produce the draft bill. The net result of all this is that 
an Indian law based on the UN Convention may not be in place even in 2011,
four years after ratification. As a consequence, the government would be unable 
to submit the mandatory periodic implementation report to the Convention
monitoring committee. A World Bank estimate puts the population of the disabled 
in India in the region of 40-80 million and among the most disadvantaged
in education, employment, and social inclusiveness. The number is bound to 
increase, given the rising trend in traffic accidents and age-related 
impairments.
The government will have to act with a greater sense of urgency to put the new 
legal framework in place because it is a basic requisite for the disabled
to improve their productive capacities and claim full citizenship.

HDFC Bank's net banking is accessible. You need to watchout for hardware
security tokens that your bank may issue. There are talking versions
available but you need to ask the bank and I suspect all banks may not have
them.

is accessible.

Depending on your needs, you can go for any bank.
SBI is my favorite from childhood, god knows why.

i can speak of similor story.
my Visa gold credit card was stolen six months ago, it was misused for
amount of 1862 Euro. i found my card missing after 4days.

i went to  police and toled them, to whom i suspaect.
there investigation led them to the guy who i named.
i was paid total amount from insurance.
so yes please confirm first about card insurance.

One of the problems most debit card users face is what would happen if the
card is stolen?

If the card happens to be the 'Visa' variety, then there is always cause for
concern. Because unlike the Master card, Visa card can be used by anyone to
purchase things without needing to present the identity verification and so
on (Master debit cards require pin number for purchases). Of course there is
regulation from the banks to check identities before accepting payments
through visa cards, but shopkeepers and sales reps cannot worry more when
someone swipes the card and pays for the purchase.

In October, I lost my Corporation Bank (Visa) debit card and didn't realise
I had lost it for nearly two days. By that time fraudulent transactions had
taken place and I lost nearly Rs. 8,000. Obviously, the card is our
responsibility and the bank is in no way obligated to return the money to
me. Though this happens to everyone, blind and sighted, people tend to view
such things as a consequence of being blind and being a terrible loser (this
is by far the biggest amount I had lost to fraud in my 15 years of working
life... Touch wood). No amount of running around to police stations and
numerous visits to the bank has yielded anything, except increasing my
frustration and disappointment over the way our system (especially law
enforcement) works. Nearly two months later, I get this news and thought how
come I didn't find this out two months before?

For the past four months, I have been a customer of Kotak Mahendra Bank
(KMB), whose service I should say has been exceptional. They have assigned
me a relationship manager who activated my debit card and internet banking
without raising a finger. She calls me up regularly to find out if I would
like to sign for online payments through Visa Bill Pay facility and I had
been thinking this was good. But now I got the news that KMB is offering
what is called a Card Protection Plan (CPP), a kind of insurance against
your debit card. The beauty is, this applies for any debit card of any bank.
For paying just Rs 1,295, you are given upto Rs 1 lakh in the event of you
losing your debit card and are unable to prevent fraudulent transactions.
You can use the service to immediately block the card and ensure no further
transactions take place. In case there are further thefts after you had
blocked the card, you are entitled for Rs 20 lakhs, since the onus of
protecting the account is with the bank once you block the card.

The annual service is automatically renewed each year unless you respond to
one of the SMS messages alerting you about the renewal and decide to
terminate it. I am not sure if this is offered to those who don't have KMB
bank account. If not, I feel you all have to take a Kotak account and see if
you can avail this service to protect yourself from loss of card and with it
considerable sum of your earnings. This is particularly good for visually
challenged persons since we are under no power to save our belongings if
someone intentionally wants to steal. Pl enquire about this at Kotak
Mahendra Bank and verify if the service is available to one and all and if
so, avail it. Also, pass this on to other VI friends and let them be
benefited by it.
