[AI] Delhi: 'Special educators for unaided pvt schools'
facing the ire of the Delhi High Court, the Directorate of Education (DoE) on Monday issued a notice to all unaided private schools of Delhi to recruit special educators and make their schools premises barrier-free so as to provide movement and access to the children with disabilities. The notice has been issued by the directorate following a mandate by the High Court asking for a compliance report at the earliest. http://www.dailypioneer.com/city/special-educators-for-unaided-pvt-schools.html According to a notice issued by Additional Director of Education Madhu Teotia, the unaided private schools of Delhi must comply with the 2012 order of the High Court which directed the schools to appoint special educators for disabled students. The court granted time till September 9 this year to appoint these special educators and time till March 2013 to make the school premises barrier-free. The matter of appointment of special educators for the disabled children and other connected issues, have again been agitated before the High Court during the proceedings of another case, wherein, the court directed the department to submit a compliance report with regard to the same along with other related directions, Teotia said. The notice also highlights that despite several reminders to private schools, this matter was not taken seriously. Teotia had asked the schools to upload special educators and disabled children related information on a module which has been made available on the Directorate of Education website. However, it has been found that most of the schools are still to upload the requisite information on the website. Therefore, in strict compliance, private schools must upload the requisite information regarding disabled children on the departmentRs s website on the aforesaid module immediately if not done so already. They should additionally appoint special educators in their schools, if not appointed so far, at the earliest but not later than the time granted by the court. They must also make their building, school premises barrier-free for the disabled children immediately, if not done yet, Teotia informed. To ensure complete compliance of the mandate, Teotia has asked all Deputy Directors of Education to monitor this case on top priority as being a High Court matter even contempt of the court is involved. The Deputy Directors of Education are expected to bring the status report in this case on August 6 to a meeting with Director of Education Padmini Singla. They are supposed to also bring along with them the names of the defaulting private schools and initiation of action against such schools. same problem created with me. When I opened the bank account initially I gave LTI for opening the account. After that slowly my requirements are going to increase. Then I applied for ATM, cheque book and other facilities which are given to the normal person. But the bank manager urged me to sign on the aplication form. I put my BST pass on the signature line by the help of their staff and simply sign below the edge of BST pass. No need to use sign gard. hi, There is no Marathi separate TTs available. However you can read Marathi unicode texts either by selecting the voice to Hindi or Nepali. Unfortunately, the numbers and name of symbols will not said in Marathi. If you used Hindi, the numbers and symbols will be said in Hindi and If you use Nepali, the number and symbols will be said in Nepali. Since you are Marathi speaker, I guess Hindi may be comfortable But as i know; In marathi, the nukta (a dot) is used and for this Nepali reads far better than Hindi. Better to test the both. hi, No more setting needed. Just set voice as Hindi or Nepali. That is all about. Mind that if you try to read any document written in traditional font, it will not work. However you can read Marathi unicode texts either by selecting the voice to Hindi or Nepali. Unfortunately, the numbers and name of symbols will not said in Marathi. If you used Hindi, the numbers and symbols will be said in Hindi and If you use Nepali, the number and symbols will be said in Nepali. Since you are Marathi speaker, I guess Hindi may be comfortable But as i know; In marathi, the nukta (a dot) is used and for this Nepali reads far better than Hindi. Better to test the both. In this public interest petition, the petitionersNational Confederation for Development of Disabled have prayed for writ of mandamus to direct the respondents to appoint the disabled persons in terms of Section 33 of the Persons with Disabilities (Equal Opportunities, Protection of Rights and Full Participation) Act, 1995 (PWD Act) in Indian Administrative Services posts to be filled up either by promotion from the State Civil Services or by selection from persons who hold gazetted posts in connection with the affairs of a state but are not members of the State Civil Services, as per their entitlement retrospectively from 1996 and to comply with the said provisions hereafter. 1 of 6 ::: Downloaded on - 03/02/2014 10:36:23 ::: Bombay High Court kambli 2 pil-106-10 3. This petition was filed on 8 December 2010. 4. In the affidavitinreply filed by Under Secretary in the Union Public Service Commission on 1 March 2011 and in the affidavitinreply dated 20 April 2012 filed by Under Secretary in the Department of Personnel and Training, Government of India, it was contended that provisions of Section 33 of PWD Act provides for reservation for the persons with disabilities only in the matter of appointment to the vacancies in the establishment. It does not provide for reservation in the matter of promotion. It was further contended that such reservation is applicable for persons with disabilities in Group C and Group D as provided in the Office Memorandum dated 20 November 1989 and in the subsequent Office Memorandum dated 29 December 2005 it is provided that 3% of the vacancies in case of promotion to Group C and Group D posts in which the element of direct recruitment, if any, does not exceed 75%, shall be reserved for persons with disabilities. It is, therefore, submitted that reservations for persons with disabilities were never available in Group A and Group B posts. It is further contended that the whole scheme of the cadre management of officers appointed by promotion to the promotion quota of an All India Service is quite different in nature from the scheme of things as are generally prevailing in the matter of promotion within the same service from a Group B/Group A post to a Group A posts. 2 of 6 ::: Downloaded on - 03/02/2014 10:36:23 ::: Bombay High Court kambli 3 pil-106-10 5. In any view of the matter, nothing is brought to our notice indicating that posts in the Indian Administrative Services are excluded from reservation for persons with disabilities. In fact, in Government of India v/s. Ravi Prakash Gupta and anr. (2010) 7 SCC 626, the Supreme Court specifically dealt with the question of reservation in the matter of appointment to All India Service and held that reservation was applicable to posts in Groups A, B, C D. The Supreme Court confirmed the decision of the High Court and issued mandamus to the Central Government to offer the writ petitioner appointment to one of the reserved posts by issuing appropriate appointment order in the Indian Administrative Services. 6. In the said decision the Supreme Court also noted in paras 20 and 26 that neither Section 32 nor Section 33 of the PWD Act make any distinction with regard to Groups A, B, C and D posts. It was further noted that proviso to Section 33 does empower the appropriate Government to exempt any establishment from the provisions of the said section, having regard to the type of work carried out in any department or establishment. No such exemption was brought to the notice of the Supreme Court on behalf of the Government of India. Nor has any such exemption been brought to our notice. 7. In view of the above, we have to proceed on the basis that the reservation is available for Group A and Group B posts as well and the same would, therefore, include posts in the Indian Administrative Services. 3 of 6 ::: Downloaded on -
