Now my reluctance has to be left behind, I'll switch over to Touch-toy. And

Three years ago, Sohan Dharmaraja was a Stanford engineering doctoral
candidate in search of his next project when he visited the Stanford
Office of Accessible Education, which helps blind and visually
challenged students successfully navigate the world of higher
education.
Though it has taken Dharmaraja and Lew a couple of years to hone, test
and perfect their creation, the full-blown iPad app, known as
iBrailler Notes, is now available to the world. The basic version of

 Under Section 80DD and Under Section 80U - where disability is 40% or
more but less than 80% the fixed deduction. The deduction earlier
allowed was Rs 50,000 which is now raised to Rs 75,000. And in case of
more than 80% disability deduction allowed was Rs 1,00,000 which is
now raised to Rs 1,25,000.
  Both claim cannot be made simultaneously by an individual assessee.
However, there is a   provision for HUF, wherein, its member is a
dependant  .

Rajesh, this particular appeal was by the DoPT challenging reservation in
Civil Services (IAS) where a strong IAS lobby was involved who did not want
to disturb their seniority due to disability quota. If this lobby could not
influence the  Supreme Court bench, I am sure RBI doesn't have more clout
that the bureaucrats! This will also be dismissed. The three bench decision
was quite strong and will be difficult to be subverted even by the present
government through the new law being proposed. I am aware of how DoPT (read
IAS lobby) will try and has been trying to scuttle the Supreme Court
judgement through the provisions of new law. But the best part is our
Judiciary has so far shown that it is above all such lobbying when it comes
to social justice!

Let the Justice prevail!

Vivek, Well the DoPT will not have any more options after this dismissal.

NAGPUR: Taking notes while someone is speaking is not the easiest thing in the 
world. It almost becomes Mission Impossible when it involves writing the board 
exam for someone else. Hundreds of students in Nagpur district appear as 
'writers' for board exam candidates, who themselves are unable to write due to 
some medical condition.

It is world in itself that exists solely due to the dedication and passion of 
'writer' students looking to help a fellow student. Organized-chaos is probably 
the best way to describe the system where writers and candidates are paired, 
guided and finally ushered into a new system every year.

Rupali Hingwe, principal BRA Mundle High school and an experienced hand of this 
system, said, "Visually impaired students or those having other medical 
ailments avail the facility of writers. The latter come from various schools 
across the city voluntarily after being certified by both their principals and 
the education board office. We pair them up taking into consideration criteria 
such as ability, age etc."

The rule says the writer has to be at least one class behind the candidate so 
there is no unfair advantage gained by using a writer. The writer is usually 
briefed informally by a teacher or experienced senior writers in school on how 
to approach the exam. This is not always the case.

Chemistry between the writer and candidate is a mix of planning and luck. 
Damodar Thombre, a teacher and Somalwar Junior college, said, "Sometimes it 
happens that both are family friends, sometimes schoolmates and sometimes plain 
strangers." The strangers too can strike a bond though. Ketan Lambat, a student 
of Centre Point School, was writer for a candidate whom he met just before the 
exam. "We were from the same school but got introduced at the last moment and 
things started rolling from there. Since our aim is the same, it makes the task 
easier."

Shivika Priyadarshi, a student of Jain International School, is a writer and 
got lucky as she met the candidate a few days before. "I got to know about her 
and made a friend. We talked about general things and that helps a lot." Last 
year CPS student Geet Katariya fractured his hand in a mishap and met his 
writer on the day of the exam. "We chatted about non-academic things like 
hobbies etc. This lightens up the situation and makes it easier for both," said 
Geet.

Another happy stakeholder is the board office. Happy, because the entire system 
works with minimal intervention from them. A board official said, "All we 
require to assign a writer and allow extra time are medical certificates from a 
government hospital and documents from the school." The rest happens in 
auto-pilot mode and just like all things in nature, this system seems to be 
getting better. Thombre said, "Students volunteer in huge numbers and whenever 
we go to classes soliciting a writer there are always more than needed."

Writer Madhav Amborkar, a student of Saraswati Vidyalaya, summed it up best by 
saying this was a sacred task. "It's not just about writing a paper, it is 
about someone's entire life and career. It is a huge responsibility that 
humbles you to the core. What I put down on that exam paper can make or break a 
person's future," he added.

Persons with disability below 80% will get exemption up to Rs. 75,000 and 
persons having severe disability (80% and above) will enjoy this benefit for 
Rs. 1,25,000 under section 80U.


As for section 80DD, I have pasted below the text I found at

Section 80DD: Deduction in respect of Rehabilitation of Handicapped 
Dependent Relative

Deduction of Rs. 50,000/- w.e.f. 01.04.2004 in respect of

1.Expenditure incurred on medical treatment, (including nursing), training 
and rehabilitation of handicapped dependent relative.
2.Payment or deposit to specified scheme for maintenance of dependent 
handicapped relative.
Further, if the defendant is a person with severe disability a deduction of 
Rs. 100,000/- shall be available under this section. The handicapped 
dependent should be a dependent relative suffering from a permanent 
disability (including blindness) or mentally retarded, as certified by a 
specified physician or psychiatrist. Note: A person with 'severe disability' 
means a person with 80% or more of one or more disabilities as outlined in 
section 56(4) of the 'Persons with disabilities (Equal opportunities, 
protection of rights and full participation)' Act.

80DD deduction is in case of the dependent of the employee whereas 80U

Adding further to Kanchan mam’s reply few of my suggestions In case of
denial of banking facility on the basis of visually impairment.

1. Please update yourself and read thoroughly existing directives from RBI
and IBA so that you can confidently answer doubts of bank officials. Keep a
copy of the circulars with you.

2. In case of denial at branch, get it in writing from branch.

3. First step is to lodge a written complaint with the branch manager as
he/she has obligation to redress it.  Attached related RBI and IBA
circulars with your detailed representation and take an acknowledgement.

4. If you are not heard or replied in 15 days escalate complaint to
respective bank’s customer care officer (banks’ internal ombudsman).  You
will find all the details on respective bank’s corporate website or IBA
website has list of all nodal officers for each bank. Visit link -

5. In addition also lodge a complaint at bank’s call center or customer
care number and take complaint number.

6. After a month of original date of complaint you can lodge complaint to

Friends, we need to lodge formal complaints as this will create records in
the bank’s internal ombudsman and with RBI when escalated.  Complaints will
create pressure and will be noted by Ministry of Finance and RBI.

Other way to sort out your denial is considering large number of VI are now
staff member of  various banks you can contact VI bank staff working in the
respected bank which has denied service.  He or she can guide you better.
However formal complaint is a must.

[AI] Problem With External Hard-Disk

Hello friends
Have a nice day to all of you.
Friends, I have a different kind of problem with one of my External hard-disk, 
having 250 gb of storage capacity. Actually, by mistake, I created recovery 
drive of my pc on that external disk instead of a pen drive, which was also 
attached with the pc on that occasion. After the completion of recovery drive, 
I couldn't understand, where the recovery drive is located cause I found my pen 
drive fully blank. Once I gone through the external drive, I was surprised to 
know that recovery drive has been created on my external drive instead of pen 
drive.
When I try to locate other data of that hard-disk, I couldn't get nun of them. 
Finally, I came to know that the storage capacity of my external drive has 
already shrinked, showing just 32 gb instead of 250 gb. I formatted the drive 
with both fat and ntfs file system alternatively but couldn't get rest of 
data/space of my external hard-disk.
Friends, let me know, whether is it possible to recover my data and storage 
capacity of  the external hard-disk?

80DD deduction is in case of the dependent of the employee whereas 80U
deduction is in case of the employee himself.

employees with disabilities in promotion
Dear Colleagues,

Please refer to my earlier posts "Physically Challenged Versus Logically

dated 10 Dec 2013 and  "SC clarifies 3% reservation in appointment for
disabled extends to promotions and deputations as well
"
dated 10 October 2014 .

Despite a three judge bench of the then Chief Justice, Justice Kurian
Joseph & Justice Rohinton Fali Nariman of the Hon'ble Supreme Court
rejecting the Centre's argument against the reservation in promotion for
persons with disabilities on 12th Sep 2014 in Special Leave to Appeal (C)
CC No(s). 13344/2014
  in
terms of The Persons with Disabilities Act 1995, the Union of India (read
DoPT) has been dilly-dallying on the implementation of the Bombay High
Court judgement in PIL 106/2010 dated 04 Dec 2013 titled
National
Confederation for Development of Disabled Versus Union of India and Ors

,  by preferring some or the other objections since September 2014.

However, finally on 27 Feb 2015, a bench of Hon'ble Chief Justice HL Dattu
and Mr. Justice AK Sikri of Hon'ble Supreme Court, have once again
dismissed a Petition for Special Leave to Appeal (C) No 5914/2015 (Arising
out of impugned final judgment and order dated 05/12/2014 in NOML No.
690/2014 in  RPL No. 85/2014 in PIL No. 106/2010 passed by the High Court
Of Bombay).

"How do you expect disabled persons to compete with the abled persons," the
bench asked while dismissing the appeal filed by the Centre against the
Bombay High Court order directing it and the Union Public Service
Commission to implement a three per cent quota in direct recruitments and
promotions for the disabled in the IAS.

*‘Disabled should get reservation in promotion’*

NEW DELHI: The Supreme Court on Friday said the government could not deny
quota in promotion to those who were appointed to a post under the
reservation policy for the physically handicapped.

A bench of Chief Justice H L Dattu and A K Sikri rejected the Union
government's plea to set aside a high court decision ordering that those
appointed in government service through physically handicapped quota would
also be entitled to reservation while getting promoted.

Arguing for the Centre, attorney general Mukul Rohatgi said there were four
categories of civil services and if a person had availed the reservation
benefit in getting a job, it would be unfair to extend the reservation
benefit yet again to him while considering him for promotion to the higher
category of service.

The bench was not convinced. It said, "Why confine the reservation benefit
only to the entry level and not for promotion. If a person is disabled, he
is always disabled. So, as long as the disability continues, he should
continue to get reservation benefits. We feel that these disabled persons
should have reservation not only at the entry level but also at the time of
promotion."

The law provides for 3% reservation to physically challenged persons in
government service. After a long adjudication process on a public interest
litigation, the apex court had directed governments to implement the quota
for disabled and fill the vacancies including backlog.

On October 8, 2013, the SC in a landmark order had directed the Centre and
states to implement within three months an 18-year-old law mandating 3%
reservation for such persons in government jobs.

The 1995 Persons with Disabilities (Equal Opportunities, Protection of
Rights and Full Participation) Act came into force on February 7, 1996
providing a minimum 3% reservation in government establishments to the
extent of 1% each for persons suffering from blindness or low vision;
hearing impairment; and locomotor disability or cerebral palsy.

The reservations will be implemented by all government departments, public
sector undertakings and government companies at the Centre and states,
enlarging opportunities for persons with disabilities
