Dear All, Given below is the petition that we have given to the National Human Rights Commission demanding the immediate release of Dr. Saibaba. On his completion of one year in the Nagpur Jail the Committee for the defence and Release of GN Saibaba, which includes activists, DU teachers etc. is organising a one day hunger strike on May 9, at the arts faculty in North Campus of the Delhi University. The programme will begin at 10.00 a.m. and will continue till the evening. All disability rights activists based in Delhi are requested to join. Text of letter sent to NHRC April 27, 2015 *Justice K.G. Balakrishnan* *Chairman* *National Human Rights Commission* *New Delhi* Dear Sir, Dr G. N. Saibaba, a 47-year old teacher in Ram Lal College of Delhi University was arrested by the Maharashtra Police on May 9, 2014, allegedly for political leanings. Even before being formally arrested, he was subjected to many indignities during his interrogation and confinement. Dr Saibaba is a wheelchair user with 90% disability. Since his arrest, he has been lodged in the Nagpur Central Jail, where he is facing tremendous difficulty owing to the jail premises being completely inaccessible. The jail authorities and the police are completely insensitive to Saibaba’s needs as a human being. For instance, his wheelchair was broken due to mishandling. No accessible toilets have been made available to him. The infrastructure within the jail premises is totally unfriendly as far as persons with disabilities are concerned. Living in such a disabled unfriendly environment and being continuously mistreated and mishandled by the jail personnel, Dr. Saibaba is in a precarious medical and health situation. Despite a recent Sessions court order which asked the jail authorities to get medical intervention, the jail authorities have not taken any action. India has signed and ratified the UN Convention on the Rights of Persons with Disabilities as also the Convention against Torture and Other Cruel, Inhuman or Degrading Treatment or Punishment. As an undertrial, Dr. Saibaba is entitled to being treated as a human being, living with dignity and be provided with basic facilities. At present Dr Saibaba is going through continuous degradation of his physical self due to the inaccessible environment and mental abuse by the concerned authorities. Despite Saibaba being an under trial, he cannot be denied his basic rights as a human being. Section 46 of the* Persons with Disabilities Act, 1995 mandates that all public buildings should be accessible (including toilets). * India has ratified the* UN convention on Rights of Persons with disability (UNCRPD). Article 13 states that the “**States Parties shall ensure effective access to justice for persons with disabilities on an equal basis with others, including through the provision of procedural and age-appropriate accommodations, in order to facilitate their effective role as direct and indirect participants, including as witnesses, in all legal proceedings, including at investigative and other preliminary stages*.” Article 14 states that “States Parties shall ensure that persons with disabilities, on an equal basis with others: (a) Enjoy the right to liberty and security of person; (b) Are not deprived of their liberty unlawfully or arbitrarily, and that any deprivation of liberty is in conformity with the law, and that the existence of a disability shall in no case justify a deprivation of liberty.” Article 15 states that* “1. **No one shall be subjected to torture or to cruel, inhuman or degrading treatment or punishment. In particular, no one shall be subjected without his or her free consent to medical or scientific experimentation. 2. States parties shall take all effective legislative, administrative, judicial or other measures to prevent persons with disabilities, on an equal basis with others, from being subjected to torture or cruel, inhuman or degrading treatment or punishment.”* Dr. Saibaba is in jail virtually without trial. The Delhi University Teacher’s Association along with many others have vociferously protested, sought his release and called for his being treated as a human being with equal rights. Dr Saibaba's case is only the latest example of the humiliation, indignity and violence that most people with disabilities are subjected to when they are arrested, incarcerated, institutionalised or otherwise engage with law-enforcement agencies. This blatant violation of the Constitution and of India's commitments under a range of international treaties should be a source of shame for every right-thinking Indian. We request the NHRC to intervene to see that that Dr Saibaba is granted bail and released. In the meanwhile the enquiry may proceed and if proved guilty, he may be proceeded against as per provisions of the law. Pending his release basic provisions required for a person with disability should be provided within the jail

I'm pasting the section here below: Title of the Bill 3.1 While examining the views of individuals/stakeholders and organizations on the Bill, it was pointed out to the Committee that the title of the Bill sounded derogatory and disparaging and therefore, needs to be modified. Across all section of stakeholders, an unanimous view emerged that the title of the Bill, may be changed and made preferably as ―Rights of Persons with Different Abilities or Special Abilities‖. 3.2 When the Ministry was asked to justify the existing title of the Bill, they in their written reply stated as under: ―The Bill is in line with UNCRPD. The UNCRPD uses the term Persons with Disabilities. Some Persons with Disabilities have objection to use of words 'differently abled' or 'specially abled‖. 3.3 The Committee are of the view that using the words “Persons with Disabilities” in the title of the Bill not only sound disparaging but also belittle the enormous talent, capacity and ability these persons possess to take up any challenge and compete with other normal human beings. Further, the present title itself declares them as „persons with disabilities‟ whereas the intention and purpose of the Bill is to empower them and give them their rightful due. In fact, the Committee themselves were awe-struck when they witnessed, during their close interaction with these people, the special knack and endowment of these people. The Committee are of the considered view that the present title of the Bill does not justify the talent and aptitude these persons own. The Committee, therefore, recommend that the Bill could be titled either as “The Rights of 24 Persons with the Different Abilities” or “The Rights of Persons with Special Abilities” or “The Rights of the Differently Able persons” which is not only more progressive and encouraging but will also help correct the discourse about the disabled people besides reducing their psychological complexes. My reading of the Standing Committee's Report I’m glad to see the Standing Committee has recommended for extending the definition of ‘establishment’ to the private sector also. However,while discussing the clause on Special Employment exchange, The committee again provides patronizing suggestion: “The Committee also want the Ministry to consider the feasibility of renaming such an exchange as Employment Exchange for Differently Able People as it appears more progressive and dynamic.” (p 33). Further, I wonder why committee has not dwelled on the issue of inaccessibility faced by blind/deaf while viewing Television programmes. In the definition of information and communication,only telecom and web-based services have been included. (p 36). On the issue of legal capacity I think government and the committee understanding have improved a bit. He stays away from the award presentation. He is too shy, too much of a recluse to come to Chennai to receive an award in front of a packed auditorium. That was all in January, 2014. Come to 2015. His The Blind Lady’s Descendants is making waves, winning critical acclaim. The book is shortlisted for The Raymond Crossword Book Award (Indian fiction category) in Mumbai. He wins the prize again, ahead of the bright and cheery Shovon Chowdhury and quiet and self-deprecating Hansda Sowvendra Shekhar. He does not show up for the award ceremony again. Flashback to life earlier: he drops out of schools. He pens four novels, sends his manuscript to different publishers and literary agents. He is turned down each time. He does not give up, confident that eventually one of his books would be published. He surprises himself; all four books are published, two of them win awards. Welcome to the multi-layered world of Anees Salim, the new age literary hermit. No book launches, no lit fests, no award ceremonies. No television interviews. Hardly any print chats either. Maybe uncertainties bring the best out of a writer. With the benefit of distance in time, what could have led to some 25 rejections? You are said to have had a feeling of being discriminated against during the phase of rejection. Could you please elaborate? Looking back, I realise what a complete novice I was back then. I did not have any knack for writing query letters and synopses. Sometimes I wrote rambling mails, sometimes curt ones. My contributions to slush pile must have been really big. I lived in a small town then, I did not know anybody important from literary circles. I wrote only to successful literary agents. I should have written to struggling ones as well, who would at least have read the manuscript to the last page before turning me down. Yes, rejections made me really sour. I started to believe that they rejected me because I had neither attended any creative writing course nor gone to a foreign university. Amazingly, when this phase ended with four books coming out in a year followed by The Hindu prize, and now the Crossword award, you remained a recluse, not quite ready to come in the public eye and relate your story…. I am a bigger recluse now than I used to be at the beginning of my writing career. I don’t think awards can make me step into the public space. I don’t miss anything by staying away from all that. My son tries everything possible to make me attend literary festivals. But I don’t see him succeeding. How comfortable are you with the idea of translations? I ask this in the light of news that two of your books are being translated into Malayalam… In fact, three of my books are being translated into Malayalam, one into Marathi. The French edition of Vanity Bagh is already out. I am curious to know how they would turn out in Malayalam, because I don’t understand any other language my books are translated into. Between Vanity Bagh and The Blind Lady Descendants which of the works has greater autobiographical elements? The Blind Lady’s Descendants . It is set in my hometown. Actually, it is mostly set in the house I lived in till I ran away from my hometown. I grew up around the characters in this book, fighting with them, patching up with them, plotting against them, sometimes even fantasising about them.
