I concur with Subhash jee.

However, now getting DoPT and state governments to actually issue notification 
for reservation in promotion for PWD has become manifold difficult with this 
judgment.

Dear Harish,

I feel the reservation in promotion in favour of SC and ST etc and reservation 
in favour of persons with disabilities are  two completely different matters. 
The SC in recent judgement in Siddaraju Vs. State of Karnataka & Ors has amply 
clarified this difference and how the limitation set by Indira Sawhney 
judgement doesn't apply to promotion in reservation for people with 
disabilities. SC had indicated in the order  “A perusal of Indra Sawhney would 
reveal that the ceiling of 50% reservation applies only to reservation in 
favour of Other Backward Classes under Article 16(4) of the Constitution of 
India whereas the reservation in favour of persons with disabilities is 
horizontal, which is under Article 16(1) of the Constitution.”

Therefore, a preferential treatment on the basis of disability duly supported 
by the Disability laws is valid and can not be equated with preferential 
treatment on the basis of caste or religion. But sadly the bureaucracy had with 
its understanding of Art 16 and selective interpretation of Indira Sawhney 
judgement, changed the language about reservation in promotion in the RPwD Act 
2016 and left it to the States to take a call on the reservation.

I feel the essence of UNCRPD, which is sought to be implemented through the new 
RPwD Act is ignored when an existing relief or better provision is taken away 
in the name of CRPD implementation. Article 4(4) o CRPD specifically provides 
as under:

"4. Nothing in the present Convention shall affect any provisions which are 
more conducive to the realization of the rights of persons with disabilities 
and which may be contained in the law of a State Party or international law in 
force for that State. There shall be no restriction upon or derogation from any 
of the human rights and fundamental freedoms recognized or existing in any 
State Party to the present Convention pursuant to law, conventions, regulation 
or custom on the pretext that the present."

Thus the new RPwD Act provisions can not take away the right to reservation in 
promotion that existed in the PWD Act 1995 in the garb of implementing CRPD. 
This must be continued in favour of the people with disabilities as it existed 
to be in compliance with article 4(4) of the convention as above.

India Government Mint, Hyderabad (IGMH), is currently minting 2019
series visually challenged-friendly coins and will soon release Rs. 20
coins.

In a statement on Sunday, Jyoti Prakash Dash, chief general manager of
IGMH said the mint rededicates itself on the foundation day to serve
the nation with a wide range of products and services. He said since
2000, India stopped importing the coins from 10 foreign countries,
including the UK and South Korea and, “now IGMH is in a position to
export coins with latest security features.”

“In addition, we are engaged in melting, refining and assaying of
silver and gold to BS standards from different temples such as TTD,
Shri Sai Sansthan Trust, Huligamma Temples, Sri Kalahasti
Devasthanam,” the officer said.

Hyderabad mint also assists the Customs Department in converting their
seized gold to bullions apart from manufacturing commemorative coins
for collectors, which can be purchased from its sales counter at
Saifabad campus, Mr. Dash said.

I feel the reservation in promotion in favour of SC and ST etc and
reservation in favour of persons with disabilities are  two completely

Four years after the Accessible India Campaign was launched to make
public offices, transport and websites accessible to persons with
disabilities (PwD), officials said at a recent review meeting that the
number of buildings of the Central Public Works Department across the
country, and websites of the Ministry of Electronics and Information
Technology (MeitY) were not known.

During the review by Social Justice and Empowerment Minister Thawar
Chand Gehlot on December 19, 2019, a Department of Empowerment of PwD
official said the “total buildings either under maintenance or owned
by CPWD are not known”, minutes of the meeting recorded. All these
buildings, along with other projects being implemented by other
Ministries, are supposed to be made accessible by March 2020.

An official of the Ministry of Housing and Urban Affairs, under which
the CPWD operates, said 787 out of 889 buildings had been made
accessible so far, while approval for 13 buildings had been received
from various Ministries and work would be started. “For the remaining
89 buildings, approval of respective Ministries is still awaited,” the
minutes said.

On government websites, Mr. Gehlot reiterated the target to make at
least 50% of the sites accessible. “However, the quantum of websites
i.e. total no. of government websites is not known,” the minutes said,
adding that Mr. Gehlot directed the MeitY to find out the total number
of the Central and State government websites.

Status of airports

With regard to transportation, the Minister noted that while there had
been progress on making airports accessible, all aspects of air
travel, including aircraft and buses used to ferry passengers from
terminals, needed to be compatible.

An official of the Civil Aviation Ministry said all 35 international
airports and 55 domestic airports under the Airports Authority of
India had been made accessible by providing ramps, and had accessible
toilets and provision for audio and Braille commands in lifts. A
Railways official said 7,000 wheelchairs had been provided at major
stations and 22 stations had online booking of wheelchair facility.

The Minister expressed concern after the Ministry of Road Transport
told him that only 3.6% of buses had been made fully accessible.

I suppose, it is a little different in this scenario. We have only Fastag which 
has no cash mandate. In all other situation we can transact in cash presently.
What is demanded in this petition is to make the POS accessible.
This can be helpful to the extent that we are fast going cashless.

stores and restaurants to accept cash for payment, saying businesses that 
accept only credit and debit cards are discriminating against New Yorkers who 
lack bank accounts and credit cards. "This practice punishes the underbanked," 
city council speaker Corey Johnson said before the council's
43-3 vote in favour of the bill. Under the bill, businesses that refuse cash 
will be fined $1,000 for the first violation and $1,500 after that. The 
measure, which is expected to go into effect by the end of the year, also 
prohibits stores from charging higher prices for paying in cash. Backers of the 
cashless model say the benefits include greater efficiency and eliminating the 
risk of theft, but opponents say millions of Americans still rely on cash. 
Philadelphia became the first US city to ban cashless stores last year. San 
Francisco and New Jersey passed similar measures soon after.
Only one jurisdiction required businesses to accept cash before 2019:
Massachusetts, which passed a law nearly 40 years ago. Backers of the New York 
City bill said that hundreds of thousands of city residents don't have bank 
accounts or credit cards and that others simply prefer to use cash.
"Whatever your reasons, consumers should have the power to choose their 
preferred method of payment," City councilman Ritchie Torres said.
Councilman Kalman Yeger, a Brooklyn Democrat, said that businesses should 
accept cash but that the local government shouldn't force them to. But some 
businesses that will be affected by the no cash ban said they will follow the 
law when it is enacted. "We are proud to do business in NYC and will of course 
comply with all NYC laws and statutes," Nick Marsh, CEO of Founders Table, 
parent company of the Chopt Creative Salad Co. and Dos Toros Taqueria chains, 
said in a statement. A company spokeswoman said six of New York City's 18 Chopt 
locations and all of its 17 Dos Toros locations are currently cashless.

I understand, there is a catch here. As per this judgement, the state 
government has to notify reservation in promotion. It could also hold good for 
us and I don't think any state government will not bother to do it for us as we 
are not a vote bank.

In a significant judgement, the Supreme Court on Friday said an individual 
cannot claim reservation as a fundamental right and the government is not bound 
to provide quota in promotion for the Scheduled Caste and Scheduled Tribe 
employees in public jobs.

A bench of Justices L Nageswara Rao and Hemant Gupta said Articles 16
(4) and 16 (4-A) of the Constitution empowered the State to make reservation in 
matters of appointment and promotion in favour of the Scheduled Castes and 
Scheduled Tribes “if in its opinion, they are not adequately represented in the 
services”.

The top court said it was for the state government to decide whether 
reservations were required in the matter of appointment and promotions to 
public posts.

“In view of the law laid down by this court, there is no doubt that the state 
government is not bound to make reservations. There is no fundamental right 
which inheres in an individual to claim reservation in promotions. No mandamus 
can be issued by the court directing the state government to provide 
reservations,”
the bench held.

The top court relied upon the Constitution bench judgements in Indra Sawhney 
(1992), M Nagaraj (2006) and Jarnail Singh (2018) and Suresh Chand Gautam
(2016) cases, among others, to set aside the Uttarakhand HC's directions issued 
on July 15, 2019 to the state government to implement reservations in promotion.

The HC's direction for filling up all future vacancies in post of Assistant 
Engineers in PWD from the members of SC/STs was “wholly unjustifiable”, it said.

The bench found the HC's direction to collect quantifiable data was “wholly 
unnecessary”, since the state government took a conscious decision not to 
provide reservation in promotions.

The court said since the State was not bound to provide reservations in 
promotions, it was not required to justify its decision on the basis of 
quantifiable data, showing adequate representation of members of the Scheduled 
Castes and Schedules Tribes in its services.

“Even if the under-representation of Scheduled Castes and Schedules Tribes in 
public services is brought to the notice of this court, no mandamus can be 
issued to the state government to provide reservation,” it said.

of the screen you will get a control "show control"
Double tap on show control button
Slide down and select "Caption and subtitle option" and double tap it.
Inside the window, use slide down / up and select audio description
option with double tap.
close the window and activate play button in the screen and you are good to go.
