Even before the discussions on the proposed amendments to the
Rehabilitation Council of India Act proceeded, the Department of
Empowerment of Persons with Disabilities has come out with a contentious
Draft University of Disability Studies and Rehabilitation Sciences Bill,
2021.



As with other legislations and policy matters, the pandemic situation is
being misused by the government to rush through another ill-conceived idea,
denying adequate time or space for stakeholders to respond. In this case, a
mere 9 days have been given to elicit response to a 131-page document.



One of the stated objects of the University is “to train and develop
professionals, researchers and educators in disability studies and
rehabilitation sciences”.



That there is a clear distinction between disability studies and
rehabilitation sciences is lost. Disability studies is an academic
discipline that examines the meaning, nature, and consequences of disability*,
*as opposed to rehabilitation, which is a process aimed at enabling the
disabled to reach and maintain their optimal physical, sensory,
intellectual, psychological and social functional levels leading to their
independence.



The dire shortage of rehabilitation professionals as also the need to
upgrade skills and facilities notwithstanding, how this can be bridged by
setting up a separate university goes unexplained. Also there exists the
Rehabilitation Council of India, which is mandated, in the main, to
regulate and monitor the training of rehabilitation professionals.



The need to promote disability studies as a discipline is one of the
mandates of the Rights of Persons with Disabilities Act. Sec. 47 of the Act
among other things entrusts upon the government the responsibility of
promoting “teaching and research in disability studies including
establishment of study centres for such studies” in all universities.
Besides, it also talks about inducting “disability as a component for all
education courses for schools, colleges, university teachers, doctors,
nurses………” etc.



Various universities in the country have established centres and are
running programmes for disabilities studies. Prominent among them are the
IGNOU, Mahatma Gandhi University, Kerala, NALSAR, Hyderabad, Ambedkar
University, Delhi, Gauhati University, Assam to name a few. This apart,
there is also the Dr. Shakuntala Misra Rehabilitation University in
Lucknow, with the stated objective of facilitating and promoting “studies,
research and extension work in the emerging areas including rehabilitation
courses…..”.



All the more unacceptable is the fact that this university would be
“self-sustaining”, in tune with the thrust of the New Education Policy
2020. With finances being generated from tuition fees, affiliation fees
etc. students from the marginalized sections will stand deprived.



In this context, it may be recalled that in 2015-16 while placing the Union
Budget the then Union Finance Minister had announced the upgradation of the
National Institute of Speech and Hearing, Thiruvananthapuram into a
National University of Rehabilitation Sciences & Disability Studies. This
was supposed to cater to students with disabilities, in the main. Approval
was denied after all the work had been done.



Rather than wasting huge amounts of money on “self-sustaining” segregated
centres of learning, it would do auger well if the government adheres to
the guiding principles of the RPD Act of equality and non-discrimination
and adopts and promotes an inclusive, multidisciplinary approach.

What an amazing app. Congratulations to the founder and the entire team for the 
vision, the focus and the eventual outcomes. Thanks to this app, I am finally 
on Whatsapp after having made several failed attempts to access Whatsapp in its 
traditional garb. Louie reduces the time it takes to perform standard Whatsapp 
functions by at least 50% if not more and since we as visually impaired folks 
sometimes take more time to perform standard functions, time is always of the 
essence. 

My experience also demonstrates the inability of mainstream apps to understand 
the essential fundamentals of accessibility. It goes without saying that it is 
lip service all the way from start to finish. The major global players are no 
exception. Here is an example:

The so called Voice Assistant from Big G was touted as an assistant especially 
for the visually impaired in a Google Conference which I was privileged to 
attend in person. In that case, even after so many years, why are several 
buttons on the home screen of the Assistant still unmarked? Talk Back, I am 
sure, delights itself and subsequently gets bored in saying unlabelled over and 
over again once the Assistant's home page is activated. The same challenge 
holds true for many other front runner apps as well.

I do not want to cite chapter and verse here but I can definitely cite dozens 
of instances where apps from the world's top three players are inaccessible in 
one way or the other. Are the accessibility teams at these mega corporations 
sleeping on the wheel and enjoying the proverbial eternal snooze? You bet!

The Indian banks, IRCTC, PayTM, on the other hand,  are an entirely different 
bag of ongoing accessibility challenges.

I think one of the attorneys in our Access India community should pick up the 
cudgels, take every violator to court and trigger hefty fines and penalties. 

Companies are not doing us any favors by paying attention to accessibility. It 
is the law both in spirit and in word. Attorneys should hit where it hurts the 
most, the corporate pocket book. Fortunately, there are several honorable 
jurors who have attempted to understand the challenges our community 
experiences every hour of the day. The recent letter to state courts regarding 
the accessibility of online legal resources is a case in point. We can 
therefore expect a certain level of support from the judiciary.

spelling errors/some fields are kept mandatory unnecessarily.
