While the Union government says nearly 5.89 crore income tax returns (ITRs)
have been filed on the new e-filing portal as on 31 December 2021, the
website, developed and maintained by Infosys Ltd, continues to frustrate
taxpayers and chartered accounts (CAs) from across the country. Many CAs
contend that their plea, which was rejected by the ministry of finance, was
not for an extension of the last date for e-filing of returns but had
sought instead a remedy to the problematic e-filing portal. Many of them
are venting out their frustration on social media.

In a hard-hitting letter last month to the finance minister Nirmala
Sitharaman, the Surat-based Chartered Accountants Association, says, “...if
the contract was awarded in January 2019, then even after the passing of 36
months, the front end of the new portal shows a brainless design with
various missing drop-down menus, buttons and missing notifications, the
backend database frequently loses data of various forms filed by the
stakeholders, the migrated data of digital signatures is totally lost after
which stakeholders took enormous pains to replenish the database with
digital signature mappings again and the overall website developed is
pathetic and hapless.”

“During these three years, the I-T department and the hired agency has not
taken the task of development seriously and has instead developed a portal
of a quality which can be developed even by college students in their
summer projects. This shows either a severe cost-cutting at the agency’s
end in the development and implementation part OR a flawed requirement with
wavering mindset provided by the I-T officials to the development agency,”
the letter says.



Till date, the ministry has given numerous extensions to Infosys to resolve
the issues being faced by taxpayers and CAs. In fact, in August 2021, FM
Sitharaman had even summoned the Infosys managing director (MD) and chief
executive officer (CEO), Salil Parekh over continuing glitches on the new
I-T e-filing portal.

Even in July last year, the finance minister had tagged Infosys, which is
managing the new portal and the company’s co-founder Nandan Nilekani,
urging them to ensure that the new I-T e-filing portal does not let
taxpayers down. She had requested them to fix glitches in the new I-T
e-filing website urgently and had appealed that easing compliance for
taxpayers at the earliest should be prioritised.



However, while finance secretary Tarun Bajaj claims that ITR filing is
going on smoothly, those who are doing the actual work are somewhat
frustrated with the portal.

“...it is rather shameful to note that the stakeholders are at the mercy of
a flawed piece of technology and are working day and night for futile
exercises like registering and re-registering on the new portal, updating
details, digital signatures and missing documents...We re-iterate that most
tax professionals and their staff have developed hypertension, insomnia,
diabetes, liver and cardiac diseases on account of their sedentary work
environment. Similar is the condition of employees of the client staff.
People are held hostage in a cyber-world with a ransom in the form of late
fees and interest and a threat to levy a penalty or to initiate
prosecution. No other words better describe the situation than the term
‘Tax Terrorism’,” the CA Association from Surat says.





“While we do not demand any extension of the due date for filing of ITRs,
considering the present situation, the I-T portal must be made fully
functional and glitch-free and the I-T department should not impose
penalty, late fee and interest upon taxpayers till that happens,” the
Association says, while placing their nine demands.



Their demands include complete waiver of penalty, interest and late fee,
condonation for the delay in filing various statutory forms, immunity from
any monetary or other consequence, setting up a grievance redressal
committee, alternative facilitation, streamlining the tendering process,
fixing accountability, rationalisation of due dates and legal backing for
citizen’s charter.

The Association in its letter, also mentions a reply received under the
Right to Information (RTI) Act. The RTI reply shows that based on
preliminary assessment, Infosys was awarded the contract for the new I-T
portal for its bid of Rs3,300 crore in January 2019. The sanctioned amount
for the work is Rs4,242 crore, which is the maximum amount that the I-T
department can spend. The project’s actual cost is not disclosed and is
based on work performed. The scope of the work is only available to the
bidders and is confidential, the RTI reply shows.

We are in an era of e-governance where most day-to-day transactions are
just a click away; but, sadly, people with disabilities are fighting for
inclusion within the digital space, since most apps and online platforms
are not designed for the visually challenged.

But it is even worse when websites like the Employee Provident Fund (EPFO)
do not take into account the needs of people with disabilities seven years
after the Central government ambitiously launched the ‘Accessible India
Campaign’, or Sugamya Bharat programme promising ‘universal accessibility’
in December 2015.

Although we have a statute called the Rights of Persons with Disabilities
Act, 2016 (RPD Act), there is an automatic violation of rights when
government websites are not available with navigators and conversion to
Braille displays, or to people with other disabilities leading to their
exclusion. Often, a mere *captcha *code, not being available in audio
format, can lead to exclusion of those who are visually impaired.

“Digital accessibility is a human right. When any government is working
towards implementing e-governance system, it should be accessible or should
be inclusive for all kinds of people. When this does not happen and the
websites are inaccessible, these sections of society are excluded and
denied of empowerment,” Pratik Rai, a Delhi-based young visually impaired
technician told *Moneylife*.

Take the case of young lawyer Turab Chimthanawala who wrote to us to
highlight the issue of inaccessibility of the Employees Provident Fund
(EPFO) website  to visually
challenged provident fund (PF) subscribers.

Mr Chimthanawala has written several mails to the EPFO pointing to the
inaccessibility of EPFO’s website  to visually challenged PF subscribers
but it has made no difference.

In the absence of social security, EPFO is a big factor in retirement
planning, so it is disturbing to visually challenged subscribers that they
cannot independently access their accounts on the EPFO website.

The visually challenged usually operate computers and mobile phones with
the assistance of a screen reader—a software which reads aloud the contents
on the screen using voice synthesised speech. However, independent access
to the EPFO website is severely restricted.

Mr Chimthanawala forwarded to us his letter to the EPFO summarising
challenges faced by the visually impaired while accessing the EPFO portal.
They are:

i. The home screen is difficult to navigate;
ii. The links on the home screen do not get easily activated;
iii. The Captcha while logging into one’s PF Account is not accessible.

“Article 21 of the Constitution of India guarantees to all persons a life
with dignity. Most visually challenged PF subscribers hold coveted
positions in reputable organisations in diverse fields. By denying them
independent access to their accounts on the EPFO website and compelling
them to depend on sighted assistance and involvement in their financial
matters, the EPFO is violating their aforementioned right to personal
dignity and privacy. India enacted the Rights of Persons with Disabilities
Act 2016 ‘the Act’, and has notified the same. EPFO is obliged to follow
the law,” Mr Chimthanawala writes.

As per Section 42 of the Act, the appropriate government shall take
measures to ensure that:

i. all contents available in audio, print and electronic media are in
accessible format;

ii. persons with disabilities have access to electronic media by providing
audio description, sign language, interpretation and close captioning;

iii. electronic goods and equipment which are meant for everyday use are
available in universal design.

Further, Section 46 of the Act mandates all service-providers, whether
government or private, to provide services in accordance with the rules on
accessibility formulated by the Central government under Section 40 within
a period of two years from the date of notification of such rules.

The Central government has notified the Rights of Persons with Disabilities
Rules 2017 ‘the Rules’. Rule 15 of the Rules provides that every
establishment shall comply with the following standards relating to
physical environment, transport and information and communication
technology, namely:

(a) Information and Communication Technology;

(b) website standard as specified in the guidelines for Indian Government
websites, as adopted by department of administrative  reforms and public
grievances, government of India;

(ii) documents to be placed on websites shall be in electronic publication
(ePUB) or optical character reader (OCR)-based pdf format:

Provided that the standard of accessibility in respect of other services
and facilities shall be specified by the Central government within a period
of six months from the date of notification of these rules.

The Act was brought into force on 19 April 2017 and the Rules were notified

An advocate by qualification, B.S. Bharathi Anna entered the party
through its student wing, the Students’ Federation of India.
B.S. Bharathi Anna, a visually-challenged CPI(M) member, has been
elected secretary of the party’s Chengalpattu district unit. This is
the first time a visually-challenged person has become a district
secretary of a party in Tamil Nadu.
An advocate by qualification, Mr. Anna entered the party through its
student wing, the Students’ Federation of India. After completing his
graduation in law from Dr. Ambedkar Government Law College, Chennai,
he started practising in Chengalpattu. “I had vision till the age of
three. Then, what was diagnosed as short-sightedness progressed into
total blindness in 2014,” he said. He was deputy secretary of Tamil
Nadu Untouchability Eradication Front. “The total loss of eyesight
prevented me from working in the field, and I resigned. I also endured
depression. But modern technology came in handy, and I started working
in the unit for the physically-challenged,” he said.
He is also the vice-president of the Tamil Nadu Association For The
Rights of All Types of Differently Abled and Caregivers.

by Hims International, USA. i purchased this display around three
years ago and it costed me approax 1 lackh eighty thousand. however,
now there is newer model available called Q braille xl adding some

Please be corrected on the following points
a) NPS is not backed by sovereign guarantee of Government of India.
The scheme is being regulated by PFRDA which is a statutory body.
However, the funds are being managed by pension fund managers (both
public sector and private sector PFMs) in conformity with the mandate
set out by PFRDA. The only benefit Government has allowed is that of
extra income tax rebate of ₹ 50,000 u/s 80CCD (1B) and 80 CCD (2) of
Income Tax Act. Even the return on debt component is not guaranteed.
If one opts for G-secs in the debt component then that is only backed
by government. Return on corporate debt fluctuates with interest rate
in the economy.
b) Kisan Credit card is not an investment product. Perhaps, you have
confused with Kisan Vikas Patra which is an investment product.
However,it is not tax-efficient. National savings certificate is a
much better product.
c)ELSS is a tax-saving investment product. it carries rebate u/s 80 C
of income tax act. Returns are linked to stock market. It is not
backed by Government.
