[AI] Is the law always respected?

2019-06-29 Thread George Abraham
59-year-old Narhari Thaker is due to officially retire in July 2020 from the
Indian Postal Service in Dungerpur, Rajasthan. But back in 2007 his
employers coerced him into taking voluntary retirement when he lost his
vision due to a hereditary eye condition.

Forced to sit idle at home at 43, his ability to provide the best for his
family was compromised. One day he tuned into an All India Radio broadcast
by Eyeway citing specific sections of the Persons with Disabilities Act
which state that no government department can lay off or ask people to
retire on grounds of disability acquired during the time of employment.

Narhari immediately contacted the Eyeway team seeking help to file a case
with the Office of the Chief Commissioner of Persons with Disabilities
(CCPD). The Commissioner ruled in his favor but the Postal Department
appealed in the Rajasthan High Court. After a long drawn legal battle, the
court ordered for Narhari's reinstatement with full back wages. In addition,
the Postal Department was fined heavily.

However, this ruling did little to change the mindsets of the officials
involved. Seven years later, he was again forced to retire. This time he
registered a complaint with the Central Administration Tribunal (CAT).
Following CAT's order, Narhari was posted to the head office in Banswara
near his residence.

The judgements in his favor have only assured the bare minimum as the
department continues to discriminate against him by denying him a promotion
till date. Furthermore, they refuse to pay him the entitled double
transportation allowance.

On one hand there are laws laid down to empower and safeguard the interests
of persons with disabilities and on the other hand, implementers of the same
law openly refute the existing guidelines. If a blind person is fully
capable of performing his job, why should the department come in the way of
earning a respectable livelihood?
