[AI] Needs legal advice for complaint filed with CCPD against SAIL.

Hi all,
I am urgently in need of some expert legal advice in a complaint filed
by me to CCPD against SAIL recruitment notice of Management Trainee
(Technical). The deadline for submitting my comments to CCPD in the
matter is 15/11/2013. It would be great help to me if someone could
advice in preparing valid points for submitting comments in favour of
my case to CCPD.
I am pasting below the entire case history in three parts:
1. My Complaint to CCPD
To

New Delhi – 110001.

SUB : Debarring Visually Impaired  candidates By SAIL in Recruitment
of Management Trainee (Technical)including Computer Science (IT).

Sir,

On the subject cited above I am to draw your kind attention towards
the recent Recruitment notice published by SAIL (Copy encl.) debarring
Visually impaired candidates for all the posts of Mgmt. Trainee
(Technical) including Computer Science(IT).

It is not out of place to mention here that today with the development
of assistive technology / screen reading software VI candidates are
competent to discharge their responsibilities assigned to them at par
with normal candidates in all walks of life. They are performing well
in various organizations on similar technical posts like Banks, FCI,
NTPC, CIL ,etc.

It appears that SAIL has not reviewed the list of identified posts
since long or has ignored the capabilities of VI candidates without
considering the recent developments in technology violating the
guidelines / provisions under Section 32(B) of the Persons with
Disabilities (Equal Opportunities, Protection of Rights and Full
Participation) Act, 1995 {1 of 1996}.

 It is, therefore, requested to kindly direct SAIL to review and
update the list of identified posts immediately to allow Visually
impaired(Blindness or low vision) candidates to apply for the post of
Management Trainee (Technical) specially in computer science(IT) with
relaxation in medical standards accordingly in the current recruitment
process.

I shall be thankful if I am Acknowledged of action taken in the matter.

Dear Sir,

Please refer to case number 34/1011/2013 dated 5th August, 2013
dispatch no.R5426 relating to the complaint by Ms. Jyotsna, a person
with 75% visual impairment.

 2. We have examined the matter at our end and as mentioned in the
notice itself, die Ministry of Social Justice  Empowerment vide
notification   no.16.70/2004-DD-III dated 18/01/2007 have not
identified MT(T) as suitable for persons with visual impairment.

 3. As regards the suggestion for employment of visually impaired
persons as programmers or software engineer, we would like to mention
that as and when such posts are advertised, Ms. Jyotsna can apply
against the same alongwith others. The nature of job being quite
different it would not be desirable to equate a Programmer with a
MT(T).

 4. In the instant case, the Management Trainees (Technical) with
Computer Science / IT background is deployed not as a programmer but
is responsible for developing and managing the automated production
processes, controlled through computer programming at the shop floor
where the steel making process is going on.
