going to the high court to file the writ petition in this regard. But
the view of government is that a visually challanged person can not

How much do you agree with this stand, can any body tell me is there

Yes. Visually challenged person can very much become a judge. Delhi
Judiciary Services places no such bar on visually challenged person to
become a judge. I myself was an examinee of Delhi Judicial Services in
year 2010 but could not clear the same. Good Initiative. You must file
a writ in the High Court or Supreme Court against such discrimination
with the persons with visual dissability.

Re: [AI] Please reply, weather a visually challanged person can become judge?

2012-04-04 Thread mukesh jain
Hello,
Presently I do not recall the exact case number I had the said details
while ago and collected the same for one of my friend who was denied
to pursue the career for as the solicitor. So I will certainly look
for the same again and let you know about it. What I remember is that
I think this case relate to Mumbai high court and if not mistaken this
was somewhere in the year 2008 and between month june or so.

Meanwhile following information may also be of some use to you.

Shri T T Chakravarthy, a 41 year old native of Arcot in Vellore
district, of Tamil Nadu achieved a rare feat in the Indian judiciary
system. He is perhaps the first visually impaired person to be
appointed as a judge in the Munsif Court. He took charge as the judge
of Coimbatore District 3rd Additional Munsif Court in June.
Chakravarthy was practicing in the district court in Vellore and later
enrolled at the Madras High Court. After successfully writing
T.N.P.S.C., he was called for the judges training and got 13th place
in the 2008 examination.
He went through a two months training in Tamil Nadu District Judicial
Academy and was a trainee judge in Valparai Court in the district.

In what can be considered as an achievement for the Indian disability
sector, the Andhra Pradesh High Court has ruled against its own
employment policy and allowed a 100 percent visually impaired person
to appear for a screening test for the post of civil judge and write
the exam with the help of an assistant.

R.Varahalaswami, a 28 year old visually impaired advocate from Guntur
applied for the post of a civil judge in the High Court in June. But
the judicial authorities rejected his application on June 16 2009
saying that he has hundred per cent visual impairment and hence cannot
be considered for the post.

He then approached the High Court challenging the rejection of his
application. A division bench comprising of Justice Ghulam Mohammed
and Justice Vilas V. Afzulpurkar said that the Registrar of the High
Court did not conform to the provisions of the Disability Act, 1995
which provides for 3 percent reservation for people with disability,
of which one percent is reserved for persons with visual impairment.
Moreover, the Registrar General in his notification did not prescribe
any disqualification to 100 percent visually impaired applicants.

The bench directed the Registrar General to allow R. Varahalaswami to
appear for the screening test and provide an assistant to help him
during the examination.

It may be mentioned that in June that year, the Madras High Court had
appointed a visually impaired person as a judge in the Munsif Court as
mentioned above.
thanks,
mukesh.

hello,
few months back i have red the news that Advocate Nandita
Dubey-Tripathi , who is visually challenged , filed the petition
challenging an advertisement of the state public service commission
for the post of civil judges that barred the visually challenged from
applying for the job. She claimed that rules do not bar such persons.

i don't have any updates about the case if any landmark judgment has
been passed yet.
persons associated with this case or the legal experts on the list may
throw light on this matter.
thanks,

Hi Mukesh do u remember which state was there against whom this case
was filed? If I know the state then I may be able to find the case.

 judge?

Friends after the stand of the Uttar Pradesh government that they are
denying blind persons in appearing in PCS judiciary exam, we are going to
the high court to file the writ petition in this regard. But the view of
government is that a visually challanged person can not act as a judge.
How much do you agree with this stand, can any body tell me is there any
such judge in India so far? It will help us in making our case more
 strong.
