in promotion to those who were appointed to a post under the reservation policy 
for the physically handicapped. 
 
 A bench of Chief Justice H L Dattu and A K Sikri rejected the Union 
 government's plea to set aside a high court decision ordering that those 
 appointed in government service through physically handicapped quota would 
 also be entitled to reservation while getting promoted. 
 
 Arguing for the Centre, attorney general Mukul Rohatgi said there were four 
 categories of civil services and if a person had availed the reservation 
 benefit in getting a job, it would be unfair to extend the reservation 
 benefit yet again to him while considering him for promotion to the higher 
 category of service. 
 
 The bench was not convinced. It said, Why confine the reservation benefit 
 only to the entry level and not for promotion. If a person is disabled, he is 
 always disabled. So, as long as the disability continues, he should continue 
 to get reservation benefits. We feel that these disabled persons should have 
 reservation not only at the entry level but also at the time of promotion. 
 
 The law provides for 3% reservation to physically challenged persons in 
 government service. After a long adjudication process on a public interest 
 litigation, the apex court had directed governments to implement the quota 
 for disabled and fill the vacancies including backlog. 
 
 On October 8, 2013, the SC in a landmark order had directed the Centre and 
 states to implement within three months an 18-year-old law mandating 3% 
 reservation for such persons in government jobs. 
 
 The 1995 Persons with Disabilities (Equal Opportunities, Protection of Rights 
 and Full Participation) Act came into force on February 7, 1996 providing a 
 minimum 3% reservation in government establishments to the extent of 1% each 
 for persons suffering from blindness or low vision; hearing impairment; and 
 locomotor disability or cerebral palsy. 
 
 The reservations will be implemented by all government departments, public 
 sector undertakings and government companies at the Centre and states, 
 enlarging opportunities for persons with disabilities eligible for benefits 
 under the law. 
 
 Rejecting the AG's arguments, the bench of Justices Dattu and Sikri said, 
 Don't give a restrictive meaning to reservation by confining it to the 
 appointment level. Disabled persons should be empowered to compete with 
 normal people in promotion.

 states to implement within three months an 18-year-old law mandating 3%
 reservation for such persons in government jobs.

 The 1995 Persons with Disabilities (Equal Opportunities, Protection of
 Rights and Full Participation) Act came into force on February 7, 1996
 providing a minimum 3% reservation in government establishments to the
 extent of 1% each for persons suffering from blindness or low vision;
 hearing impairment; and locomotor disability or cerebral palsy.

 The reservations will be implemented by all government departments, public
 sector undertakings and government companies at the Centre and states,
 enlarging opportunities for persons with disabilities eligible for benefits
 under the law.

 Rejecting the AG's arguments, the bench of Justices Dattu and Sikri said,
 Don't give a restrictive meaning to reservation by confining it to the
 appointment level. Disabled persons should be empowered to compete with
 normal people in promotion.

 When the AG argued further against grant of reservation benefits in
 promotion to disabled persons, the bench cut it short by telling him that
 persons belonging to Scheduled Castes and Schedule Tribes got the benefit of
 reservation both in appointment and promotion.

Awaiting a New Revolution in the Practice of Physiotherapy
by the Visually Challenged

 

Pre Launch Concept Note, March 14, 2011: Physiotherapy has
been practiced by the visually challenged since early last century, and they
have been acknowledged widely for their contribution in this field.

 

The visually challenged physiotherapists have been
practicing physiotherapy using both manual techniques and electrotherapy
equipments. In the absence of any accessibility features in the electrotherapy
equipments, the visually challenged users always depended on ingenious
adaptations and workarounds to use these machines. They had to memorize the
different options on the electrotherapy units and had to be very precise whilst
using the same. The visually challenged physiotherapists had to rely on the
little beeps and clicks in order to set the various parameters of treatment.

 

With the advent of modern technology and increasing
complexity of the electrotherapy equipments, the visually challenged
physiotherapists were left behind and had to depend on using the older versions,
when the rest of the world was adopting newer technology.

In this age of right to accessibility it was imperative that
the modern electrotherapy equipments were made user friendly for the visually
challenged as they were for their sighted physiotherapists.

 

In the year 2010, the Xavier’s Resource Centre for the
Visually Challenged (XRCVC) made it possible for students with visual
impairment get admission in to mainstream Physiotherapy courses in Mumbai and
is currently working on the same being done at other mainstream universities
and colleges across the country. With the admission of Ms. Kritika Purohit at 
Seth G.S. Medical College
and KEM Hospital in their Bachelor of
Physiotherapy course, new challenges in accessibility were thrown open which
the XRCVC took up. The XRCVC began this by creating accessible study material
and tactile diagrams that will help Kritika and other visually impaired
students learn and understand better. In addition given the need for use of
electrotherapy equipments in daily practice, the XRCVC took up this challenge
and in partnership with two leading manufacturers of electrotherapy equipments
in India is going to launch
for the first time in India,
a completely accessible range of electrotherapy products.

 

This sort of innovation has never been done before in the
field of physiotherapy equipments. The use of audio and visual inputs into main
stream electrotherapy equipment shall convert the seemingly inaccessible
machine into a perfect user friendly unit, which would transform the way in
which the visually challenged physiotherapists treat their patients.

Wireless Vision Implant: Implantable Prosthesis Lets Patients Perceive
Visual Images
ScienceDaily (June 2, 2008) — About 30 million people around the world
have grown legally blind due to retinal diseases. The EPI-RET project
has sought for a technical solution for the past twelve years to help
these patients. This work has resulted in a unique system – a fully
implantable visual prosthesis.

For twelve years, experts from different disciplines in the fields of
microelectronics, neurophysics, information engineering, computer
science, materials science and medicine have been working to develop a
visual prosthetic device for patients who have lost their sight
through diseases of the retina.
In September 2007, their effort was rewarded. In a clinical study
including six patients, the team was able to demonstrate not only that
a completely implantable vision prosthesis is technically feasible and
proven functioning, but also that it enables patients to perceive
visual images.
For normally sighted people that may not seem much, but for the
Blind, it is a major step, comments Dr. Hoc Khiem Trieu from the
Fraunhofer Institute for Microelectronic Circuits and Systems IMS in
Duisburg. After years of blindness, the patients were able to see
spots of light or geometric patterns, depending on how the nerve cells
were stimulated.
Dr. Hoc Khiem Trieu has been involved from the outset of this project,
which was funded by the German Ministry of Education and Research.
Together with Dr. Ingo Krisch and Dipl.-Ing. Michael Görtz he
translated the specifications given by the medical experts and
material scientists into an implant and chip design. The scientists
are to receive the Joseph von Fraunhofer Prize 2008 for their work.
A milestone was reached when the prosthetic system finally operated
wirelessly and remotely controlled, explains Dr. Ingo Krisch. A
great deal of detailed work was necessary before the implant could be
activated without any external cable connections.
The designs became smaller and smaller, the materials more flexible,
more robust and higher in performance, so that the implant now fits
comfortably in the eye, reports Michael Görtz. The system benefits
from a particular disease pattern, and it uses a specific operating
principle to restore sight: Suffering from retinitis pigmentosa, the
light sensitive cells are destroyed, but the connection of the nerve
cells to the brain remains intact.
The scientists have bypassed the defects of the retina by means of a
visual prosthesis. The complete system comprises the implant and an
external transmitter integrated in a spectacle-frame. The implant
system converts the image patterns into interpretable stimulation
signals. Data and energy are transferred to the implant by a
telemetric link. The nerve cells inside the eye are then stimulated
according to the captured images. Those intact cells are innervated by
means of three-dimensional stimulation electrodes that rest against
the retina like small studs.
EPI-RET GmbH, a spin-off of this project consortium, intends to market
the vision prosthesis in about three years' time after a new clinical
study of selected patients has been completed with the final product.
